我國高校知識產(chǎn)權(quán)保護的現(xiàn)狀及對策研究

【摘要】:創(chuàng)新是經(jīng)濟增長的動力源泉,是社會發(fā)展的中堅力量,是國家持續(xù)進步的靈魂所在。國家創(chuàng)新體系是社會可持續(xù)發(fā)展的有力保障,是培養(yǎng)創(chuàng)新型人才的重要保證,是提高國家綜合實力和國際競爭力的堅實支柱。我國目前正在構(gòu)建國家創(chuàng)新體系,,并積極推進知識產(chǎn)權(quán)戰(zhàn)略的實施。高校是知識創(chuàng)新和技術(shù)創(chuàng)新的核心,肩負著自主創(chuàng)造知識產(chǎn)權(quán)的重要使命。為配合國家創(chuàng)新體系的構(gòu)建和知識產(chǎn)權(quán)戰(zhàn)略的實施,以提高高校知識產(chǎn)權(quán)運作水平為目標,提升我國高校的科研能力和創(chuàng)新能力,本文對高校知識產(chǎn)權(quán)保護展開了研究。 文章首先對知識產(chǎn)權(quán)和高校知識產(chǎn)權(quán)保護的相關(guān)概念進行了界定,為后面各章節(jié)的研究提供了理論基礎(chǔ),并對高校知識產(chǎn)權(quán)保護的必要性進行了分析,肯定了我國高校知識產(chǎn)權(quán)保護工作取得的成績。但目前仍存在知識產(chǎn)權(quán)意識淡薄、知識產(chǎn)權(quán)教育體系不完善、科研成果轉(zhuǎn)化不利、管理機構(gòu)不健全等問題,這些問題是導(dǎo)致我國高校知識產(chǎn)權(quán)保護和管理工作落后、知識產(chǎn)權(quán)戰(zhàn)略實施進程比較緩慢的重要原因。為解決這些問題,筆者對美國和日本的高校知識產(chǎn)權(quán)保護情況進行了介紹,在借鑒其相關(guān)經(jīng)驗的基礎(chǔ)上,總結(jié)了幾點啟示,最后提出一些完善高校知識產(chǎn)權(quán)保護的對策和建議,包括加強知識產(chǎn)權(quán)保護的宣傳、構(gòu)建全面的知識產(chǎn)權(quán)教育體系、建立有效的知識產(chǎn)權(quán)成果轉(zhuǎn)化機制、健全高校知識產(chǎn)權(quán)管理體制和完善知識產(chǎn)權(quán)法律保障體系五個方面,以期為維護高校利益、推進國家知識產(chǎn)權(quán)戰(zhàn)略的實施和中國特色國家創(chuàng)新體系的構(gòu)建略施綿薄之力。
[Abstract]:Innovation is the motive source of economic growth, the backbone of social development and the soul of national sustainable progress. The national innovation system is the strong guarantee of social sustainable development and the important guarantee of cultivating innovative talents. China is now building a national innovation system and actively promoting the implementation of intellectual property strategy. Universities and colleges are the core of knowledge innovation and technological innovation. In order to cooperate with the construction of national innovation system and the implementation of intellectual property strategy, to improve the operation level of intellectual property in colleges and universities, to enhance the scientific research ability and innovation ability of colleges and universities in our country. This article has carried on the research to the university intellectual property right protection. This paper first defines the related concepts of intellectual property rights and intellectual property protection in colleges and universities, and provides a theoretical basis for the research of the following chapters, and analyzes the necessity of intellectual property protection in colleges and universities. This paper affirms the achievements of intellectual property protection in colleges and universities in China. However, there are still some problems, such as weak awareness of intellectual property rights, imperfect educational system of intellectual property rights, unfavorable transformation of scientific research achievements, imperfect management institutions, etc. These problems are the important reasons for the backward protection and management of intellectual property in colleges and universities in China, and the slow implementation of intellectual property strategy. The author introduces the situation of intellectual property protection in colleges and universities in the United States and Japan. On the basis of drawing lessons from the relevant experiences, the author summarizes some enlightenments, and finally puts forward some countermeasures and suggestions to improve the protection of intellectual property rights in colleges and universities. It includes strengthening the propaganda of intellectual property protection, constructing a comprehensive intellectual property education system, establishing an effective mechanism for the transformation of intellectual property achievements, perfecting the intellectual property management system in colleges and universities and perfecting the intellectual property legal protection system. In order to safeguard the interests of colleges and universities, promote the implementation of the national intellectual property strategy and the construction of national innovation system with Chinese characteristics.
