【摘要】：賦予高等學校學生自治權是高等學校法治化進程的必然選擇。從培養(yǎng)具有民主、科學意識的現(xiàn)代公民角度出發(fā),學生權利結構不僅應包括我國現(xiàn)行教育法律法規(guī)中所列舉的權利內(nèi)容,而且應通過修訂《高等教育法》等相關教育法律規(guī)定,增加學生的學習自由權、校務參與權、有限自治權等權利內(nèi)容。但受根深蒂固的特別權力關系等因素的影響,人們對我國高校學生自治權的認識比較模糊。要徹底剔除現(xiàn)有不合理制度的安排,應在堅守法律保留原則、比例原則、正當程序原則等基礎上,從修訂或制定相關教育法律法規(guī)、健全高校學生自治組織、完善高校學生法律救濟渠道等層面保障高校學生自治權。
[Abstract]:It is an inevitable choice to endow college students with autonomy in the process of ruling by law in colleges and universities, from the angle of cultivating modern citizens with democratic and scientific consciousness. The structure of students' rights should not only include the contents of the rights listed in the current educational laws and regulations, but also increase the students' right to freedom of study by amending the relevant educational laws such as the higher Education Law. The right to participate in school affairs, limited autonomy and other rights. But by deep-rooted special power relationship and other factors. The understanding of the autonomy of college students in our country is rather vague. In order to thoroughly eliminate the arrangement of the existing unreasonable system, we should adhere to the principle of legal reservation, the principle of proportionality, the principle of due process and so on. From the aspects of revising or formulating relevant educational laws and regulations, perfecting the autonomous organization of college students and perfecting the channels of legal relief for college students, the autonomy of college students is guaranteed.
