【摘要】：我國的獨(dú)立學(xué)院產(chǎn)生于二十世紀(jì)九十年代末，是隨著我國高等教育的高速發(fā)展應(yīng)運(yùn)而生的一種新型高等學(xué)校。這種新穎的辦學(xué)方式既能夠通過吸引民間教育資本，解決我國高等教育經(jīng)費(fèi)不足的問題，又能夠發(fā)揮普通高等學(xué)校在教學(xué)師資，教學(xué)管理，科研能力方面的專業(yè)優(yōu)勢，以滿足我國人民對于高等教育的巨大需求。獨(dú)立學(xué)院的發(fā)展，為我國高等教育從精英化教育轉(zhuǎn)型為大眾化教育，起到了巨大的推動作用。 然而，獨(dú)立學(xué)院的發(fā)展過程并非一帆風(fēng)順，我國政府于2008年由教育部出臺了《獨(dú)立學(xué)院設(shè)置與管理辦法》以規(guī)范獨(dú)立學(xué)院的發(fā)展并解決獨(dú)立學(xué)院面臨的種種問題。按照《辦法》的精神，所有的獨(dú)立學(xué)院都必須完成轉(zhuǎn)型以成為真正意義上的獨(dú)立的辦學(xué)實(shí)體。雖然有不少學(xué)者研究了獨(dú)立學(xué)院轉(zhuǎn)型中的各種問題，但是獨(dú)立學(xué)院轉(zhuǎn)型中國有資產(chǎn)的流失問題研究卻幾乎是一片空白。國有資產(chǎn)在獨(dú)立學(xué)院轉(zhuǎn)型中確實(shí)存在流失的事實(shí)，研究這個問題不僅是為了國民經(jīng)濟(jì)的發(fā)展，同時也是為了獨(dú)立學(xué)院轉(zhuǎn)型后的健康順利發(fā)展，為國家高等教育提供更多更好的教育產(chǎn)品。 本論文依據(jù)產(chǎn)權(quán)理論、公共產(chǎn)品理論、法人治理結(jié)構(gòu)理論，對獨(dú)立學(xué)院中國有資產(chǎn)存在的形式進(jìn)行探討，通過對與獨(dú)立學(xué)院轉(zhuǎn)型中，防止國有資產(chǎn)流失的現(xiàn)有相關(guān)政策利弊進(jìn)行歷史分析、法律法規(guī)分析，定量分析與定性研究相結(jié)合的方法，運(yùn)用理論論證、事實(shí)論證、類比論證相結(jié)合對政策的準(zhǔn)確性和有效性進(jìn)行研究，提出政策的完善措施，為政府?dāng)M定獨(dú)立學(xué)院轉(zhuǎn)型中防止國有資產(chǎn)流失政策提出參考意見。通過研究本論文發(fā)現(xiàn)，首先，我國政府對防止獨(dú)立學(xué)院轉(zhuǎn)型中國有資產(chǎn)的流失缺乏必要的重視和監(jiān)管；其次針對獨(dú)立學(xué)院產(chǎn)權(quán)評估政策缺失和缺乏對母體高校的無形國有資產(chǎn)評估；另外現(xiàn)行獨(dú)立學(xué)院政策下，獨(dú)立學(xué)院法人界定不清且學(xué)院利益主體權(quán)責(zé)利模糊。這些現(xiàn)象歸根到底都將會造成國有資產(chǎn)的流失。本論文從政策完善方面提出解決上述問題的一些建議與方法，，以確保資產(chǎn)的優(yōu)化配置和利用。期待能夠?qū)φ谵D(zhuǎn)型中的獨(dú)立學(xué)院的國有資產(chǎn)管理起到拋磚引玉的作用。
[Abstract]:The independent college of our country is born in the late 1990 's and is a new type of higher education as the high-speed development of higher education in our country. This novel way of running a school can solve the problem of the shortage of the Chinese higher education through attracting the private educational capital, and also can play a professional advantage in the teaching staff, the teaching management and the scientific research ability of the general higher education institution, in order to meet the great demand of our people for higher education. The development of the independent college has played an important role in the transformation of higher education from the elite to the popularization of education. However, the development process of the independent college is not smooth. In 2008, the government of our country introduced the setting and management of the independent college by the Ministry of Education in order to regulate the development of the independent college and solve the problems facing the independent college. In accordance with the spirit of the , all independent colleges must complete the transition to become a real and independent school. Although many scholars have studied the various problems in the transformation of the independent college, the research on the loss of assets in the independent college is almost empty The fact that the state-owned assets have lost in the transformation of the independent college is not only for the development of the national economy, but also for the healthy and smooth development of the independent college after the transformation, so as to provide more and better education for the higher education of the state This paper, based on the theory of property right, the theory of public product and the theory of corporate governance structure, discusses the form of the existence of the assets in the independent college. Through the analysis of the advantages and disadvantages of the existing related policies to prevent the loss of the state-owned assets in the transformation of the independent college, the legal method The method of the combination of gauge analysis, quantitative analysis and qualitative research is to study the accuracy and effectiveness of the policy with the combination of the theory demonstration, the fact demonstration and the analogy demonstration, and put forward the perfect measure of the policy, and provide the reference for the government to draw up the policy of preventing the loss of state-owned assets in the transformation of the independent college. On the basis of the research of this paper, the author finds out that, in the first place, the government of our country has a lack of the necessary attention and supervision to the loss of assets in China's transition from the independent college, and the second is the lack of the independent college property right evaluation policy and the lack of the intangible state-owned assets of the parent colleges and universities.
