獨(dú)立學(xué)院窘境的成因及破解問題研究

【摘要】:獨(dú)立學(xué)院是在我國高等教育改革與發(fā)展中自發(fā)形成的新事物,同時(shí)也是我國高等教育從精英教育向大眾化教育轉(zhuǎn)變的最有效形式之一。它擴(kuò)寬了高等教育本科層次的教育資源,增添了高等教育的辦學(xué)活力,同時(shí)也滿足了人民群眾對接受高等教育多樣化的需求。獨(dú)立學(xué)院從無到有,是在諸多爭論中不斷地探索與博弈,最終異軍突起。為讓獨(dú)立學(xué)院辦學(xué)得到規(guī)范,教育部依據(jù)相關(guān)法律法規(guī),先后頒布了多項(xiàng)政策條例,并給予五年整改的過渡期。然而,在即將面臨教育部的審核之際,絕大部分獨(dú)立學(xué)院在“有否民間資金投入”這一最核心和最基本,作為其存在的法律基礎(chǔ)的關(guān)鍵點(diǎn)上,存在著巨大差異,與教育部驗(yàn)收標(biāo)準(zhǔn)相距甚遠(yuǎn)。若嚴(yán)格執(zhí)行政策規(guī)范,則必有眾多獨(dú)立學(xué)院停止辦學(xué)或被撤銷;若不嚴(yán)格執(zhí)行,則影響國家法律法規(guī)的權(quán)威!(dú)立學(xué)院的發(fā)展陷入進(jìn)退維谷的窘境。 對壘的一方是國家正式頒布的法律法規(guī)與政策,另一方則是眾多高校的黨委領(lǐng)導(dǎo)班子審慎的決定與實(shí)施。究竟是前者本身出了問題必然受到的強(qiáng)烈抵制,還是后者“上有政策,下有對策”導(dǎo)致的“政策出不了中南海”?獨(dú)立學(xué)院面臨發(fā)展窘境,破解該問題勢在必行。筆者認(rèn)為,在與舉辦獨(dú)立學(xué)院相關(guān)的五方主體(舉辦高校、投資合作方、獨(dú)立學(xué)院管理方以及中央政府和地方政府)之間,各自不同的利益訴求和行為目標(biāo)所導(dǎo)致的博弈,是該問題產(chǎn)生的內(nèi)在原因和本質(zhì)所在。獨(dú)立學(xué)院未來的發(fā)展方向,只能依據(jù)相關(guān)主體間博弈變化來加以重新定位。文章將 對與舉辦獨(dú)立學(xué)院相關(guān)的五方主體博弈進(jìn)行研究,歸納出獨(dú)立學(xué)院窘境的成因,其中包括:學(xué)院法律地位、學(xué)院管理體制、學(xué)院辦學(xué)模式、學(xué)院辦學(xué)行為。通過研究獨(dú)立學(xué)院各主體的行為目標(biāo),探究得出博弈均衡的路徑。解決這些問題,首先,,明確獨(dú)立學(xué)院是民辦的高等教育機(jī)構(gòu),合理界定出參與舉辦者間的產(chǎn)權(quán)關(guān)系;其次,政府進(jìn)一步完善獨(dú)立學(xué)院相關(guān)政策,從根本上明確獨(dú)立學(xué)院管理運(yùn)作的體制,建立起社會(huì)參與監(jiān)督、管理的機(jī)制;然后,獨(dú)立學(xué)院舉辦各方嚴(yán)格依法辦學(xué),獨(dú)立學(xué)院加強(qiáng)自身建設(shè),提高教育教學(xué)質(zhì)量,最終形成自己的辦學(xué)特色。
[Abstract]:Independent college is a new thing formed spontaneously in the reform and development of higher education in our country, and it is also one of the most effective forms of the transformation of higher education from elite education to popular education. It broadens the educational resources at the undergraduate level of higher education, increases the vitality of running higher education, and meets the needs of the people for the diversification of higher education. From scratch, independent colleges are constantly exploring and playing games in many debates, and finally sprang up. In order to standardize the running of independent colleges, the Ministry of Education has promulgated a number of policies and regulations in accordance with relevant laws and regulations, and has given a transition period of five years. However, when facing the examination of the Ministry of Education, the vast majority of independent colleges have great differences in the core and the most basic point of "whether or not private funds are invested", which is the key point of their existence as the legal basis. It is far from the acceptance standard of the Ministry of Education. If we strictly carry out the policies and regulations, many independent colleges will stop running or be abolished. If they are not strictly enforced, the development of independent colleges will fall into a dilemma. One side is the laws, regulations and policies officially promulgated by the state, the other is the prudent decision and implementation of the leading bodies of the Party committees of many colleges and universities. Is it the strong resistance of the former to its own problems, or the fact that the latter "has a policy on the top, and measures to deal with", resulting in "no policy out of Zhongnanhai"? The independent college is faced with the dilemma of development, so it is imperative to solve the problem. The author believes that there are different interests and behavior goals between the five main bodies (the host university, the investment partner, the management of the independent college and the central government and local government) related to the establishment of the independent college. It is the internal cause and essence of the problem. The future development direction of independent colleges can only be reoriented according to the game changes between relevant subjects. In this paper, the author studies the game of the five parties involved in the independent college, and concludes the causes of the dilemma of the independent college, including: the legal status of the college, the management system of the college, the mode of running the school and the behavior of the school. By studying the behavior objectives of the subjects in the independent colleges, we can find out the path of game equilibrium. To solve these problems, first of all, it is clear that the independent college is a private higher education institution, and the property right relationship among the participants is reasonably defined. Secondly, the government further improves the relevant policies of the independent college. It is fundamental to make clear the system of management and operation of independent colleges, and to establish a mechanism for social participation, supervision and management. Then, independent colleges run schools strictly according to law, and independent colleges strengthen their own construction and improve the quality of education and teaching. Finally, the formation of their own school characteristics.
