【摘要】：當(dāng)前，大學(xué)章程在我國的高等教育改革中倍受關(guān)注。我國的大學(xué)章程建設(shè)雖然取得重大進(jìn)展，但也存在諸多問題。鑒于此，本文采用文獻(xiàn)研究法、歷史研究法、比較研究法等方法對我國大學(xué)章程功能阻滯問題及其疏通策略進(jìn)行探究。 本文的主體內(nèi)容分為如下五個部分： 第一部分分析了大學(xué)章程的本質(zhì)與要素。大學(xué)章程是規(guī)定大學(xué)辦學(xué)理念、組織體系、運作原則的根基性文件，是大學(xué)的制度基礎(chǔ)。大學(xué)章程包括理念界定、治理結(jié)構(gòu)、權(quán)限設(shè)定等基本要素。 第二部分在對國內(nèi)外大學(xué)章程建設(shè)的比較研究的基礎(chǔ)上，重點分析大學(xué)章程功能的發(fā)揮機制。大學(xué)章程的功能發(fā)揮依賴于法律保障、大學(xué)自治、學(xué)術(shù)自由等條件。 第三部分分析我國大學(xué)章程建設(shè)及其功能發(fā)揮狀況。我國現(xiàn)代大學(xué)章程的建設(shè)經(jīng)歷了清末、民國、新中國等歷史時期。當(dāng)前，，我國大學(xué)章程即發(fā)揮著積極功能，也存在著約束力不足、易受外部力量沖擊等功能發(fā)揮受限問題。 第四部分分析了我國大學(xué)章程功能發(fā)揮受限的原因。大學(xué)章程功能發(fā)揮受限源自于我國高等教育的特殊歷史進(jìn)程、高度集中的政治體制、官本位思想與高校行政化、法律意識欠缺等因素。 第五部分分析了我國大學(xué)章程的優(yōu)化思路。在制度維度上，要保障大學(xué)自治、建立共同治理機制、完善相關(guān)法律體系；在觀念維度上，要強化法律意識、重塑大學(xué)的獨立品格。
[Abstract]:At present, the university charter has attracted much attention in the reform of higher education in our country. Although great progress has been made in the construction of university charter in our country, there are still many problems. In view of this, this paper uses the methods of literature research, history research and comparative research to probe into the problem of university charter function block and its dredging strategy in our country. The main content of this paper is divided into five parts as follows: The first part analyzes the essence and elements of the university charter. The charter of university is the basic document that prescribes the idea, organization system and operation principle of the university, and is the foundation of the institution of the university. The university charter includes basic elements such as concept definition, governance structure, authority setting and so on. The second part, on the basis of comparative research on the construction of university charter at home and abroad, focuses on the exertion mechanism of university charter function. The function of university constitution depends on legal guarantee, university autonomy, academic freedom and so on. The third part analyzes the status of university constitution construction and its function. The construction of the constitution of modern universities in China has experienced the historical periods of the late Qing Dynasty, the Republic of China and New China. At present, the university charter of our country not only plays a positive role, but also has some problems, such as lack of binding force and easy to be impacted by external forces. The fourth part analyzes the reason why the function of university charter is restricted. The function of university charter is limited by the special historical process of higher education in China, the highly centralized political system, the ideology of officialdom and the administration of higher education, the lack of legal consciousness and so on. The fifth part analyzes the optimization thought of the university charter in our country. In the system dimension, we should guarantee the autonomy of the university, establish the common governance mechanism and perfect the related legal system. In the concept dimension, we should strengthen the legal consciousness and reshape the independent character of the university.
