【摘要】：迄今為止,以互聯(lián)網(wǎng)為代表的現(xiàn)代信息技術(shù)已經(jīng)將很多行業(yè)進(jìn)行重新洗牌。依托于互聯(lián)網(wǎng),我國(guó)傳統(tǒng)經(jīng)濟(jì)開始向網(wǎng)絡(luò)經(jīng)濟(jì)轉(zhuǎn)型,網(wǎng)絡(luò)經(jīng)濟(jì)帶來(lái)的巨大效益是在傳統(tǒng)經(jīng)濟(jì)中從來(lái)未曾出現(xiàn)過(guò)的。首先,任何信息都可以在網(wǎng)絡(luò)中來(lái)回的傳遞,沒(méi)有時(shí)間的限制,沒(méi)有空間的限制,沒(méi)有種族的限制,沒(méi)有地域的限制。巨大的信息交換量必然會(huì)帶給我們更多的交易機(jī)會(huì)。在節(jié)省了時(shí)間和空間的同時(shí)也大大降低了經(jīng)營(yíng)成本,自然就創(chuàng)造出了更多的經(jīng)濟(jì)效益。 然而,凡事都是喜憂參半,互聯(lián)網(wǎng)亦是如此。網(wǎng)絡(luò)經(jīng)濟(jì)雖然正在飛速增長(zhǎng),而且其增長(zhǎng)速度絲毫沒(méi)有下降的趨勢(shì),但這并不能說(shuō)明網(wǎng)絡(luò)經(jīng)濟(jì)帶來(lái)的都是正面影響，其之所以帶來(lái)經(jīng)濟(jì)激增是因?yàn)槠潺嫶蟮幕鶖?shù),換句話說(shuō)就是巨大的交易量。相比而言,網(wǎng)絡(luò)不正當(dāng)經(jīng)濟(jì)糾紛案件要比傳統(tǒng)經(jīng)濟(jì)糾紛案件的數(shù)量更為龐大。在更多更好的交易出現(xiàn)的同時(shí),必然要面對(duì)其帶來(lái)的負(fù)面影響。網(wǎng)絡(luò)不正當(dāng)競(jìng)爭(zhēng)就是最明顯的特例,有部分網(wǎng)絡(luò)經(jīng)銷商受誘惑于網(wǎng)絡(luò)環(huán)境下新型不正當(dāng)競(jìng)爭(zhēng)行為的低成本、高收益,利用網(wǎng)絡(luò)特性來(lái)使?fàn)I銷手段多樣化,但這些基于不正當(dāng)競(jìng)爭(zhēng)的營(yíng)銷手段不但破壞了網(wǎng)絡(luò)市場(chǎng)的公平競(jìng)爭(zhēng)秩序,也對(duì)整個(gè)市場(chǎng)經(jīng)濟(jì)帶來(lái)了一定的負(fù)面影響。由于網(wǎng)絡(luò)的快速發(fā)展在我國(guó)時(shí)間并不是很長(zhǎng),1993年出臺(tái)的《反不正當(dāng)競(jìng)爭(zhēng)法》對(duì)于網(wǎng)絡(luò)市場(chǎng)具有一定滯后性,同時(shí)不正當(dāng)競(jìng)爭(zhēng)行為由于其有別于傳統(tǒng)不正當(dāng)競(jìng)爭(zhēng)的新特性,一定程度上來(lái)說(shuō)他們不屬于《反不正當(dāng)競(jìng)爭(zhēng)法》的規(guī)制范圍,因而部分網(wǎng)絡(luò)背景下的不正當(dāng)競(jìng)爭(zhēng)行為在法律規(guī)制方面仍得不到及時(shí)的、有針對(duì)性的處理。因此,補(bǔ)充完善現(xiàn)行《反不正當(dāng)競(jìng)爭(zhēng)法》以及建立一個(gè)新的網(wǎng)絡(luò)立法體系是十分必要的。 本文從正、反兩個(gè)方面分析了網(wǎng)絡(luò)經(jīng)濟(jì)對(duì)競(jìng)爭(zhēng)所產(chǎn)生的影響,并根據(jù)目前已經(jīng)存在的網(wǎng)絡(luò)不正當(dāng)競(jìng)爭(zhēng)形式,總結(jié)歸納出網(wǎng)絡(luò)不正當(dāng)競(jìng)爭(zhēng)行為的特點(diǎn)并對(duì)網(wǎng)絡(luò)不正當(dāng)競(jìng)爭(zhēng)行為進(jìn)行分類。通過(guò)舉例來(lái)對(duì)照分析得出我國(guó)存在的相關(guān)法律法規(guī)的一些漏洞,最后提出相關(guān)的整改措施,包括完善法律責(zé)任規(guī)定、建立反網(wǎng)絡(luò)不正當(dāng)競(jìng)爭(zhēng)執(zhí)法的聯(lián)動(dòng)機(jī)制、完善《反不正當(dāng)競(jìng)爭(zhēng)法》的相關(guān)配套法律法規(guī)等措施,并提出將反網(wǎng)絡(luò)不正當(dāng)競(jìng)爭(zhēng)單獨(dú)立法的構(gòu)想及在立法過(guò)程中需要注意的幾個(gè)方面,希望能在我國(guó)網(wǎng)絡(luò)經(jīng)濟(jì)領(lǐng)域的法律制度體系建立過(guò)程中起到一定的積極作用。
[Abstract]:So far, the modern information technology represented by the Internet has reshuffled many industries. Relying on the Internet, the traditional economy of our country began to transform into the network economy, and the enormous benefits brought by the network economy have never appeared in the traditional economy. First of all, any information can be passed back and forth in the network, there is no time limit, no space limit, no race restriction, no geographical restriction. The huge amount of information exchange will inevitably bring us more trading opportunities. Save time and space, but also greatly reduce operating costs, natural created more economic benefits. However, everything is mixed, and so is the Internet. Although the network economy is growing rapidly, and its growth rate is not declining in any way, it does not mean that the network economy has brought about all the positive effects. It has brought about an economic surge because of its huge base. In other words, huge volumes. In contrast, the number of cases of economic disputes on the Internet is larger than that of traditional economic disputes. At the same time more and better transactions appear, it is inevitable to face its negative impact. Network unfair competition is the most obvious special case. Some network dealers are tempted by the low cost and high profit of the new unfair competition behavior under the network environment, and make use of the network characteristic to make the marketing means diversified. However, these marketing methods based on unfair competition not only destroy the fair competition order of the network market, but also bring some negative effects to the whole market economy. Because the rapid development of the network is not very long in our country, the Anti-unfair Competition Law issued in 1993 has a certain lag to the network market, at the same time, the unfair competition behavior is different from the traditional unfair competition because of its new characteristics. To a certain extent, they do not belong to the scope of anti-unfair competition law, so the unfair competition behavior under the network background still can not be dealt with in time and pertinently in the aspect of legal regulation. Therefore, it is necessary to supplement and perfect the current Anti-unfair Competition Law and establish a new network legislation system. This paper analyzes the influence of network economy on competition from positive and negative aspects, and according to the existing forms of unfair network competition, Summarizes the characteristics of network unfair competition behavior and classifies the network unfair competition behavior. By comparing and analyzing some loopholes of relevant laws and regulations in our country, the author puts forward some relevant rectification measures, including perfecting the legal liability regulations, establishing the linkage mechanism of anti-network unfair competition law enforcement. To perfect the relevant laws and regulations of Anti-unfair Competition Law, and put forward the idea of separate legislation on anti-network unfair competition and several aspects that should be paid attention to in the process of legislation. Hope to play a positive role in the establishment of legal system in the field of network economy.
