【摘要】：我國的工傷保險(xiǎn)制度已經(jīng)歷了數(shù)十年的發(fā)展歷程,但是現(xiàn)階段我國的工傷保險(xiǎn)制度還存在著重補(bǔ)償輕預(yù)防的問題。隨著我國社會經(jīng)濟(jì)的不斷高速發(fā)展,這種重補(bǔ)償輕預(yù)防的工傷保險(xiǎn)制度已不適應(yīng)市場經(jīng)濟(jì)的要求,嚴(yán)重影響社會的穩(wěn)定發(fā)展,引發(fā)了一系列問題,如工傷事故增加的問題、工傷保險(xiǎn)基金運(yùn)行壓力問題、勞資糾紛問題、社會穩(wěn)定問題等。改變工傷保險(xiǎn)制度的重補(bǔ)償輕預(yù)防現(xiàn)狀,建立工傷預(yù)防工作機(jī)制,已經(jīng)刻不容緩。為此,黨中央、國務(wù)院高度重視,將工傷保險(xiǎn)制度改革,構(gòu)建工傷預(yù)防工作機(jī)制作為改善民生的一個(gè)重點(diǎn)工作來抓。2009年,人力資源和社會保障部發(fā)布《關(guān)于開展工傷預(yù)防試點(diǎn)工作有關(guān)問題的通知》,在廣東省、海南省、河南省各選四個(gè)城市開展工傷預(yù)防試點(diǎn)工作。2010年,國務(wù)院修改的《工傷保險(xiǎn)條例》中規(guī)定工傷預(yù)防的宣傳、培訓(xùn)等費(fèi)用從工傷保險(xiǎn)基金中列支。2013年,人力資源和社會保障部在《關(guān)于進(jìn)一步做好工傷預(yù)防試點(diǎn)的通知》中指出工傷預(yù)防試點(diǎn)的目標(biāo)是探索建立科學(xué)、規(guī)范的工傷預(yù)防工作模式,為在全國范圍內(nèi)開展工傷預(yù)防工作積累經(jīng)驗(yàn),完善我國工傷預(yù)防制度體系。在這樣的大背景下,本文首先運(yùn)用理論分析法對工傷預(yù)防和工傷保險(xiǎn)的相關(guān)基本概念和基本理論進(jìn)行了研究。其次運(yùn)用比較分析法對國外不同類型的工傷預(yù)防工作機(jī)制構(gòu)建的模式和國內(nèi)具有代表性的地區(qū)對工傷預(yù)防工作的試點(diǎn)和探索進(jìn)行了研究,總結(jié)出對我國進(jìn)行工傷預(yù)防工作機(jī)制構(gòu)建有益的啟示和經(jīng)驗(yàn)借鑒。再次運(yùn)用案例分析法,結(jié)合南京市工傷保險(xiǎn)經(jīng)辦過程中的典型案例,對我國現(xiàn)行的與工傷預(yù)防有關(guān)的工作機(jī)制現(xiàn)狀和存在的主要問題進(jìn)行了分析,揭示了問題產(chǎn)生的根源和工作中存在的難點(diǎn),總結(jié)出我國工傷預(yù)防工作機(jī)制構(gòu)建的改革方向。根據(jù)上述分析與研究,最終提出了我國工傷預(yù)防工作機(jī)制構(gòu)建的框架：一是我國工傷預(yù)防工作機(jī)制構(gòu)建的三個(gè)階段性戰(zhàn)略目標(biāo)；二是我國工傷預(yù)防工作機(jī)制構(gòu)建的重點(diǎn)環(huán)節(jié)和基本原則；三是我國工傷預(yù)防工作機(jī)制構(gòu)建的路徑選擇；四是對我國工傷預(yù)防工作機(jī)制構(gòu)建的政策建議。希望本文的研究能為我國工傷預(yù)防工作機(jī)制構(gòu)建的實(shí)踐以及相關(guān)研究提供一些幫助。
[Abstract]:The industrial injury insurance system of our country has gone through decades of development, but at the present stage, the industrial injury insurance system in our country still has the problem of paying more attention to compensation than prevention. With the rapid development of our country's social economy, The industrial injury insurance system, which emphasizes compensation and neglects prevention, is no longer suitable for the requirements of the market economy, seriously affecting the stable development of society, causing a series of problems, such as the increase in industrial accidents and the operating pressure of the industrial injury insurance fund. Labor disputes, social stability issues, etc. It is urgent to change the current situation of emphasizing compensation over prevention in the industrial injury insurance system, and to establish a working mechanism for industrial injury prevention. For this reason, the Party Central Committee and the State Council have attached great importance to the reform of the industrial injury insurance system. In 2009, the Ministry of Human Resources and Social Security issued a notice on issues related to the pilot work of industrial injury prevention. In Guangdong Province and Hainan Province, Henan Province selects four cities each to carry out pilot work on industrial injury prevention. In 2010, the regulations on Industrial injury Insurance revised by the State Council stipulated that the costs of publicity and training for industrial injury prevention were covered from the Industrial injury Insurance Fund. In 2013, The Ministry of Human Resources and Social Security pointed out in the circular on further doing well the pilot work of industrial injury prevention that the goal of the pilot project is to explore the establishment of a scientific and standardized work model for industrial injury prevention. In order to accumulate experience in the nationwide work of industrial injury prevention and improve the system of industrial injury prevention in our country, under such a background, In this paper, the basic concepts and theories of industrial injury prevention and industrial injury insurance are studied by means of theoretical analysis, and then the mode of construction of different types of work-related injury prevention mechanisms in foreign countries and the basic theories are analyzed by means of comparative analysis. Representative regions in China have carried out research on the pilot and exploration of industrial injury prevention work. This paper summarizes the useful inspiration and experience for the construction of work mechanism of industrial injury prevention in our country. Again, it uses case analysis method to combine with typical cases in the process of industrial injury insurance administration in Nanjing. This paper analyzes the present working mechanism and main problems related to the prevention of work-related injuries in China, and reveals the root causes of the problems and the difficulties existing in the work. According to the above analysis and research, the paper finally puts forward the framework of the construction of the work mechanism of industrial injury prevention in China: first, the three strategic objectives of the construction of the work mechanism of industrial injury prevention in China; The second is the key links and basic principles of the construction of the work mechanism of industrial injury prevention in China, the third is the path choice of the construction of the work mechanism of industrial injury prevention in our country. The fourth part is the policy recommendations on the construction of the working mechanism of industrial injury prevention in China. I hope that the research in this paper can provide some help for the practice of the construction of the work mechanism of industrial injury prevention in our country and the related research.
