【摘要】：正案情簡(jiǎn)介2012年7月5日,某建筑公司承包一單位辦公大樓的建設(shè)施工。樁基工程完工后,該建筑公司將腳手架工程分包給包工頭張某。2012年12月上旬,張某指派其招用的李某等人從事腳手架搭設(shè)作業(yè)。2012年12月12日,李某在腳手架搭設(shè)作業(yè)過(guò)程中因操作不慎,從高處墜落受傷,隨后被急送當(dāng)?shù)蒯t(yī)院救治。治療終結(jié)后,李某向人力資源和社會(huì)保障局申請(qǐng)工傷認(rèn)定,因李某不能提供其與某建筑公司之間存在勞動(dòng)關(guān)系的證明材料,遂向勞動(dòng)人事爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁,請(qǐng)求確認(rèn)李某與某建筑公司之間存在勞動(dòng)關(guān)系。
[Abstract]:Is the case in July 5, 2012, the construction of a construction company contracted a unit office building pile foundation. After the end of treatment, Lee to the human resources and Social Security Bureau for related injuries, because Lee can not provide the proof material with a construction company labor relations between, then to the labor dispute arbitration committee for arbitration. The request to confirm the labor relations between Lee and a construction company.
