【摘要】：雖然不能否認律師事務所盈利目的所在,但律師事務所提供的服務與一般商事企業(yè)有著明顯的區(qū)別。律師事務所的客戶更看重律師個人執(zhí)業(yè)水平和職業(yè)道德,而一般商事企業(yè)客戶關系的維系則主要依賴企業(yè)的信譽。這種差異決定了律師事務所客戶名單商業(yè)秘密保護具有自身的特殊性,在顧及客戶選擇律師事務所或律師自由權的同時,還要考慮律師事務所與律師之間利益的合理平衡。與美國等發(fā)達國家律師事務所與律師關系相比,我國律師事務所對律師開發(fā)客戶的投入比例明顯偏低,大部分律師要自行尋找訴訟或非訟項目,因此在平衡律師與律所在客戶關系上的利益時應該向律師傾斜。
[Abstract]:Although we can not deny the profit purpose of the law firm, the service provided by the law firm is obviously different from that of the ordinary commercial enterprise. The clients of law firms pay more attention to the professional ethics and professional ethics of lawyers, while the maintenance of customer relationship in general business enterprises mainly depends on the reputation of the enterprises. This difference determines that the protection of the client list of law firms has its own particularity. It is necessary to consider the reasonable balance between the interests of law firms and lawyers while taking into account the clients' choice of law firms or lawyers' right of freedom. Compared with the relationship between law firms and lawyers in developed countries such as the United States, the proportion of investment of law firms in the development of clients in our country is obviously on the low side. Most lawyers have to seek litigation or non-litigation projects on their own. Therefore, in balancing the interests of lawyers and law firms in customer relations should be biased towards lawyers.
