【摘要】：客戶身份識別制度不僅事關(guān)金融交易的安全與秩序,而且對預(yù)防與遏制洗錢、恐怖融資等犯罪行為亦具有重大意義。雖然在這一制度的構(gòu)建上,我國已推出一系列規(guī)范性文件,但是隨著社會演進(jìn)、交易方式的日新月異、科學(xué)技術(shù)的推陳出新,時下的制度面臨時滯性、利益沖突、識別手段陳舊、體系化缺失及資源不能共享等困境。為了破解這些難題,我國有必要立于互聯(lián)網(wǎng)金融的時代背景,從理念轉(zhuǎn)型、利益平衡、責(zé)任強(qiáng)化和義務(wù)主體擴(kuò)展等角度進(jìn)行制度改良的突破。
[Abstract]:Customer identification system is not only related to the security and order of financial transactions, but also of great significance to the prevention and control of money laundering, terrorist financing and other criminal acts. Although in the construction of this system, China has launched a series of normative documents. But with the evolution of society, the rapid change of trading methods, the innovation of science and technology, the current system is faced with the dilemmas of time delay, conflicts of interests, obsolete means of identification, lack of systematization and the inability to share resources, etc. In order to solve these problems, It is necessary for our country to break through the reform of the system from the angle of idea transformation, benefit balance, responsibility strengthening and the extension of the subject of obligation in the background of the times of Internet finance.
