【摘要】:政府補貼是公私融合的現(xiàn)代市場經(jīng)濟條件下政府介入產(chǎn)業(yè)發(fā)展的常用的方法。其在實踐中正外部性與負外部性并存,應通過法律規(guī)制促使其得以優(yōu)化和規(guī)范。政府主導經(jīng)濟發(fā)展的傳統(tǒng)放大了以資金補助為代表的政府補貼對我國新能源汽車產(chǎn)業(yè)的促進功能,同時也存在補貼的實體與程序規(guī)則缺乏法治理念、補貼缺乏其他公共政策協(xié)同等問題,并產(chǎn)生了干擾市場供求、破壞公平競爭等體制性的弊端,以及產(chǎn)銷數(shù)據(jù)與實際使用數(shù)據(jù)出現(xiàn)巨大落差、車企大面積騙補等市場性的不足。當前應以法治為理念統(tǒng)攝新能源汽車產(chǎn)業(yè)政府補貼規(guī)則的確定和執(zhí)行,重點強化對補貼規(guī)則的競爭中立審查,促進補貼與新能源汽車充電產(chǎn)業(yè)政策等公共政策之間的協(xié)同,優(yōu)化補貼的績效評估與調(diào)整、退出機制以提高補貼的科學性與精準性,并嚴格追究騙補行為的違法責任。
[Abstract]:Government subsidy is a common method for government intervention in industrial development under the condition of public and private integration in modern market economy. In practice, both positive externalities and negative externalities coexist. It should be optimized and standardized through legal regulation. The tradition of government-led economic development magnifies the promotion function of government subsidies represented by capital subsidies to China's new energy automobile industry. At the same time, there are some problems such as the lack of the concept of the rule of law in the substantive and procedural rules of subsidies, the lack of coordination of other public policies, and the existence of institutional drawbacks such as interfering with the supply and demand of the market and destroying fair competition. As well as the huge gap between production and marketing data and the actual use of data, large areas of car companies to compensate for the shortcomings of the market. Currently, we should take the rule of law as the concept to control the determination and implementation of the government subsidy rules of the new energy automobile industry. The emphasis is on strengthening the competition review of subsidy rules, promoting the synergy between subsidies and other public policies, such as the new energy vehicle charging industry policy, and optimizing the performance evaluation and adjustment of subsidies. Withdrawal mechanism to improve the scientific nature and accuracy of subsidies, and strict accountability for fraud and compensation.
