【摘要】：正編者按:目前我國(guó)刑法學(xué)界對(duì)事實(shí)因果關(guān)系的判斷基本都主張條件說(shuō),同時(shí),對(duì)法律因果關(guān)系的標(biāo)準(zhǔn)則見(jiàn)解不一,在我國(guó)犯罪論體系可能面臨轉(zhuǎn)型或改進(jìn)的當(dāng)下,與探討選擇哪種因果關(guān)系理論同樣重要的是研究法律因果關(guān)系判斷的具體規(guī)則。本刊選取的以下三篇論文,均從方法論的視角歸納不同因果關(guān)系理論中合理的成分,設(shè)計(jì)法律因果關(guān)系判斷的具體規(guī)則。希望它們的刊出,能夠有助于克
[Abstract]:The editor's note: at present, the judgment of factual causality in the field of criminal law in our country is basically based on the theory of condition, and at the same time, there are different opinions on the standard of legal causality. At present, the criminal theory system of our country may be faced with transformation or improvement. Just as important as exploring which causality theory to choose is to study the specific rules of legal causality judgment. From the perspective of methodology, the following three papers are selected to conclude the reasonable components of different causality theories and to design the specific rules of legal causality judgment.
