【摘要】：我國(guó)自1979年重新確認(rèn)地方立法權(quán)以來(lái),擁有地方立法權(quán)的主體不斷擴(kuò)大,地方立法蓬勃發(fā)展。雖然地方立法有效地填補(bǔ)了我國(guó)立法的空白,在法制建設(shè)中發(fā)揮了重大作用,但也出現(xiàn)了很多問(wèn)題,如重復(fù)立法、越權(quán)立法、立法抵觸與沖突等。這不僅導(dǎo)致了立法資源的浪費(fèi),而且也造成了法律適用上的困難。產(chǎn)生這些問(wèn)題的原因很多,但最終我們必然會(huì)追溯到我國(guó)地方立法權(quán)的配置上來(lái)。本文從立法權(quán)配置的角度來(lái)審視地方立法中存在的問(wèn)題,為實(shí)踐中如何配置地方立法權(quán)提供可能的參考。除前言與結(jié)論之外,本文正文部分共四章,其主要內(nèi)容如下： 第一章主要對(duì)新中國(guó)成立以來(lái)地方立法權(quán)配置的歷史進(jìn)行考察,試圖挖掘推動(dòng)我國(guó)地方立法權(quán)配置發(fā)展演變的背后影響因素,進(jìn)而指出我國(guó)地方立法權(quán)在發(fā)展演變過(guò)程中的問(wèn)題和特點(diǎn),為下文的論證奠定基礎(chǔ)。 第二章主要是論證我國(guó)地方立法權(quán)的正當(dāng)性。地方立法權(quán)自存在以來(lái),爭(zhēng)議不斷,本章從不同理論學(xué)說(shuō)和國(guó)情基礎(chǔ)的角度展開(kāi),論證了我國(guó)地方立法權(quán)存在的正當(dāng)性。 第三章與第四章分別從外部與內(nèi)部不同的視角來(lái)討論我國(guó)地方立法權(quán)的配置這一主題。其中第三章主要論述中央與地方之間立法權(quán)配置中的問(wèn)題,包括國(guó)家立法權(quán)與地方立法權(quán)之間、中央行政立法權(quán)與地方立法權(quán)之間權(quán)力配置。第四章將視角轉(zhuǎn)向地方立法的內(nèi)部,探討地方立法權(quán)配置中的問(wèn)題與不足,并指出優(yōu)化立法權(quán)配置的可能措施。
[Abstract]:Since our country reconfirmed the local legislative power in 1979, the main body with the local legislative power has been expanding and the local legislation is booming. Although the local legislation has effectively filled the blank of our country's legislation and played an important role in the construction of the legal system, there are also many problems, such as repeated legislation, ultra vires legislation, legislation conflict and so on. This not only led to the waste of legislative resources, but also caused difficulties in the application of the law. There are many reasons for these problems, but eventually we will trace back to the allocation of local legislative power. This paper examines the problems existing in the local legislation from the perspective of the allocation of the legislative power, and provides a possible reference for how to allocate the local legislative power in practice. In addition to the preface and conclusion, there are four chapters in the text. The main contents are as follows: the first chapter mainly investigates the history of the allocation of local legislative power since the founding of New China. This paper attempts to excavate the influential factors behind the development and evolution of the allocation of local legislative power in China, and then points out the problems and characteristics in the process of development and evolution of local legislative power in China, which lays a foundation for the following argumentation. The second chapter is to demonstrate the legitimacy of local legislative power. Since the existence of local legislative power, there have been many disputes. This chapter starts from different theories and national conditions, and proves the legitimacy of the existence of local legislative power in China. The third and fourth chapters discuss the allocation of local legislative power from the external and internal perspectives. The third chapter mainly discusses the allocation of legislative power between the central and local governments, including the allocation of power between national and local legislative power, central administrative legislative power and local legislative power. In the fourth chapter, we turn the angle of view to the interior of local legislation, discuss the problems and shortcomings in the allocation of local legislative power, and point out the possible measures to optimize the allocation of legislative power.
