【摘要】：強(qiáng)迫失蹤或非志愿失蹤是一種嚴(yán)重的侵犯人權(quán)行為。國際社會高度關(guān)注強(qiáng)迫失蹤問題,要求主權(quán)國家保護(hù)國內(nèi)人民免遭強(qiáng)迫失蹤的國際規(guī)范已經(jīng)逐步得到確立和發(fā)展。"保護(hù)的責(zé)任"則是國際社會人權(quán)保護(hù)觀念與原則的新發(fā)展,其所蘊(yùn)含的總體性的原則觀念和框架義務(wù)對各種人權(quán)保護(hù)構(gòu)成了新的原則指導(dǎo)和依據(jù),以及相關(guān)規(guī)范進(jìn)一步變化發(fā)展的基礎(chǔ)與動力。在"被強(qiáng)迫失蹤或非志愿失蹤問題"方面,需要依據(jù)"保護(hù)的責(zé)任"的國際新觀念與原則不斷地明確和強(qiáng)化"強(qiáng)迫失蹤問題"的國內(nèi)治理責(zé)任和實(shí)踐,同時(shí),反過來進(jìn)一步豐富和推進(jìn)"保護(hù)的責(zé)任"的內(nèi)涵構(gòu)成與具體實(shí)施。
[Abstract]:Enforced or involuntary disappearances are a serious human rights violation. The international community is highly concerned about the issue of enforced disappearance, and international norms requiring sovereign States to protect their populations from enforced disappearance have been progressively established and developed. " The responsibility to protect "is a new development of the concept and principle of human rights protection in the international community, which contains a general concept of principles and framework obligations which constitute new guidelines and bases for the protection of human rights," And the basis and motive force of the further change and development of related norms. In the context of "enforced or involuntary disappearances", there is a need to continuously clarify and strengthen the domestic governance responsibilities and practices of "enforced disappearances" in accordance with the new international concepts and principles of the "responsibility to protect", In turn, further enrich and promote the "responsibility to protect" the connotation of the composition and implementation.
