學(xué)術(shù)自由的憲法保護(hù)

【摘要】:學(xué)術(shù)自由既是高等教育有待深入研究的重要理論問題,也是現(xiàn)代大學(xué)發(fā)展所面臨的實踐問題,作為現(xiàn)代大學(xué)的重要內(nèi)涵和大學(xué)發(fā)展的重要條件,越來越多的學(xué)者開始關(guān)注對學(xué)術(shù)自由的研究及其保護(hù)問題,尤其是法律保護(hù)問題。本文第一部分從對學(xué)術(shù)自由的內(nèi)涵入手,主要探討了學(xué)術(shù)自由的定義、學(xué)術(shù)自由的價值、學(xué)術(shù)自由的限度等內(nèi)容幫助讀者理清有關(guān)學(xué)術(shù)自由的基本概念;第二部分介紹了學(xué)術(shù)自由的歷史演變以及學(xué)術(shù)自由在我國的發(fā)展和現(xiàn)狀等內(nèi)容,以期對學(xué)術(shù)自由在國內(nèi)外的發(fā)展做一脈絡(luò)梳理;第三部分探討了學(xué)術(shù)自由的權(quán)利屬性,主要分析了作為一種憲法權(quán)利的學(xué)術(shù)自由權(quán)與一般意義上的學(xué)術(shù)自由之間的異同,介紹了學(xué)術(shù)自由權(quán)的主體范圍及權(quán)利內(nèi)容,進(jìn)一步探討了學(xué)術(shù)自由與大學(xué)自治之間的關(guān)系,學(xué)術(shù)自由與憲政之間的關(guān)系;第四部分梳理了各國學(xué)術(shù)自由憲法保護(hù)的歷史發(fā)展與現(xiàn)狀以及我國憲法對學(xué)術(shù)自由保護(hù)的相關(guān)規(guī)定;第五部分探討了學(xué)術(shù)自由的侵權(quán)與救濟(jì),包括對學(xué)術(shù)自由的侵權(quán)認(rèn)定以及學(xué)術(shù)自由的救濟(jì)途徑等,主要目的在于將實踐中常會出現(xiàn)的對學(xué)術(shù)自由的侵權(quán)方式及救濟(jì)途徑展現(xiàn)給讀者,并在此基礎(chǔ)上對以憲法為中心加強(qiáng)對學(xué)術(shù)自由的保障提出合理化的建議。本研究結(jié)合我國高校目前的實際情況,力圖反映出我國目前高校在理論和實踐上對學(xué)術(shù)自由的認(rèn)識和保障存在的問題,嘗試從憲法的高度,通過完善立法、加強(qiáng)司法、減少行政干預(yù)、推動大學(xué)內(nèi)部治理結(jié)構(gòu)改革等方式構(gòu)建完備的學(xué)術(shù)自由保護(hù)體系,以期為保護(hù)學(xué)術(shù)自由,促進(jìn)我國學(xué)術(shù)自由的發(fā)展提供有益參考。
[Abstract]:Academic freedom is not only an important theoretical problem to be deeply studied in higher education, but also a practical problem facing the development of modern universities. As an important connotation of modern universities and an important condition for their development, More and more scholars begin to pay attention to the research and protection of academic freedom, especially the legal protection. The first part of this paper starts with the connotation of academic freedom, mainly discusses the definition of academic freedom, the value of academic freedom, the limits of academic freedom and so on, which helps readers to clarify the basic concepts of academic freedom. The second part introduces the historical evolution of academic freedom, the development and status quo of academic freedom in China, in order to sort out the development of academic freedom at home and abroad, the third part discusses the right attribute of academic freedom. This paper analyzes the similarities and differences between academic freedom as a constitutional right and academic freedom in general, introduces the subject scope and content of academic freedom, and further discusses the relationship between academic freedom and university autonomy. The fourth part combs the history development and the present situation of the constitutional protection of academic freedom and the relevant provisions of the constitution of our country to the protection of the academic freedom; the fifth part discusses the infringement and relief of the academic freedom. The main purpose of this paper is to show the readers the infringing ways and remedies of academic freedom, which are often found in practice, including the recognition of the infringement of academic freedom and the remedy of academic freedom. On the basis of this, some reasonable suggestions are put forward to strengthen the guarantee of academic freedom with the constitution as the center. This research combines the actual situation of our country's colleges and universities at present, tries to reflect the existing problems of the understanding and guarantee of academic freedom in the theory and practice of our country's colleges and universities at present, tries to strengthen the judicature from the constitutional height, through consummates the legislation, strengthens the judicature. In order to protect academic freedom and promote the development of academic freedom in China, the administrative intervention should be reduced and the reform of university internal governance structure should be promoted.
