【摘要】：美國聯(lián)邦上訴法院法官漢德在"美國訴丹尼斯案件(United States v.Dennis)"中,從憲法經(jīng)濟(jì)學(xué)視角對具有一定經(jīng)濟(jì)邏輯的言論自由、出版自由的憲法規(guī)則進(jìn)行分析,提出了丹尼斯公式,將其作為一種衡量言論限制、新聞限制合理與否、適當(dāng)與否的憲法經(jīng)濟(jì)學(xué)準(zhǔn)則。該準(zhǔn)則對于探求言論自由維度的啟示是:有害言論成功率的高低決定了社會對于該言論的容忍程度;特別危機(jī)情形的出現(xiàn)才能使言論控制、新聞檢查獲得理所當(dāng)然的正當(dāng)性。結(jié)合經(jīng)濟(jì)學(xué)的邊際效用原則,丹尼斯公式顯示:一定地域內(nèi),報(bào)刊雜志數(shù)量越多,"另類"聲音的效用越是受到抑制,言論和新聞限制的力度可降低,即降低報(bào)刊雜志的發(fā)行門檻,是抑制"另類"聲音效用有效的低成本途徑。
[Abstract]:In the case of United States v. Dennis, Judge of the Federal Court of Appeals of the United States analyzed the constitutional rules of freedom of speech and freedom of the press with certain economic logic from the perspective of constitutional economics, and put forward the Dennis formula. As a measure of whether the restrictions on speech, the restrictions on news are reasonable, The implication for exploring the dimension of freedom of speech is that the success rate of harmful speech determines the degree of tolerance of the society for the expression, and that the emergence of special crisis situations can make speech control. Censorship is justifiably justified. Combined with the marginal utility principle of economics, Dennis's formula shows that the more newspapers and magazines there are in a given region, the more the utility of "alternative" voices is suppressed. Restrictions on speech and news can be reduced, that is to say, lowering the threshold for publication of newspapers and magazines is an effective low-cost way to curb the effectiveness of "alternative" voices.
