【摘要】：美國豐富的憲法解釋實踐告訴我們,有關(guān)憲法解釋理論之爭,重點在于憲法解釋方法之爭。本文結(jié)合美國憲法案例,全面分析了美國違憲審查中憲法解釋方法的理論和實踐。 鑒于在美國司法實踐中,并不是所有提交聯(lián)邦法院的違憲審查請求都會啟動違憲審查程序,并進(jìn)一步進(jìn)行憲法解釋。因此,本文第一章介紹了在違憲審查中憲法解釋的前提。首先,美國憲法解釋是由普通法院作為解釋主體。其次,法院在進(jìn)行違憲審查前,先要基于對立法機(jī)關(guān)的尊重而回避做出與憲法相關(guān)的解釋,包括回避做出憲法判斷及回避做出違憲的憲法判斷。 第二章討論了美國憲法解釋方法的傳統(tǒng)路徑。闡釋了文義、原旨、歷史和目的解釋方法的含義、應(yīng)用,及困境反思。本章不意在區(qū)分各種解釋方法,而在于分析各種方法之啟示,引導(dǎo)在憲法解釋實踐中綜合考慮各種方法,以最大程度保障公民權(quán)利和實現(xiàn)憲法價值。 第三章分析了美國憲法解釋方法的現(xiàn)代發(fā)展。在彌補(bǔ)傳統(tǒng)憲法解釋方法不足的基礎(chǔ)上,解釋者不囿于傳統(tǒng)的解釋方法,發(fā)展出了利益衡量、原則闡釋和結(jié)果考量的憲法解釋方法。 第四章分析和評述了美國憲法的解釋方法。首先,歸納了憲法解釋方法的特質(zhì)；其次,分析了美國憲法解釋方法的影響因素；最后,嘗試提出憲法解釋方法的選擇方法。我國雖無違憲審查制度,但卻有解釋憲法和保障公民權(quán)利的需求,因此,研究美國憲法解釋實踐,對我國理解憲法價值和保障公民權(quán)利具有重要的意義。
[Abstract]:The rich practice of constitutional interpretation in the United States tells us that the dispute about the theory of constitutional interpretation is focused on the dispute of the method of constitutional interpretation. This paper, in combination with the case of American Constitution, comprehensively analyzes the theory and practice of the method of constitutional interpretation in the review of unconstitutionality in the United States. Given that in judicial practice in the United States, not all requests for review of constitutionality before a federal court will initiate a review process for unconstitutionality and further constitutional interpretation... therefore, The first chapter introduces the premise of constitutional interpretation in the review of unconstitutionality. Firstly, the interpretation of the Constitution of the United States is conducted by ordinary courts as the main body of interpretation. First of all, we should make constitutional interpretation based on respect for the legislature, including avoiding constitutional judgment and unconstitutional constitutional judgment. The second chapter discusses the traditional ways of interpreting the American Constitution. It explains the meaning, application, and dilemma of the interpretation methods of the meaning, the original purpose, the history and the purpose. It lies in analyzing the enlightenment of various methods and guiding the comprehensive consideration of various methods in the practice of constitutional interpretation in order to protect the civil rights and realize the constitutional value to the greatest extent. The third chapter analyzes the modern development of the American constitutional interpretation method. On the basis of making up for the deficiency of the traditional constitutional interpretation method, the interpreter is not confined to the traditional interpretation method, and develops the interest measurement. Interpretation of principles and results of the constitutional interpretation method. Chapter 4th analyzes and comments on the interpretation methods of the American Constitution. Firstly, it sums up the characteristics of the interpretation methods of the Constitution; secondly, it analyzes the influencing factors of the methods of the interpretation of the Constitution of the United States; finally, it analyzes the factors affecting the interpretation of the Constitution. Although there is no unconstitutional review system in China, there is a need to interpret the constitution and protect the rights of citizens. Therefore, this paper studies the practice of constitutional interpretation in the United States. It is of great significance for our country to understand the constitutional value and protect the civil rights.
