【摘要】：公共服務類事業(yè)單位改革的成功與否以及在多大邊際范圍內(nèi)起作用直接關系到社會治理的有效性。我國事業(yè)單位改革以“政事分離”、“管辦分離”為原則和宗旨,取得了一些成績,然而改革的“老”、“大”、“難”問題始終懸而未決,近乎陷于積重難返的困境。香港法定機構(gòu)自立于香港特別行政區(qū)行政、立法和司法的權(quán)力框架之外,即作為法律規(guī)定的、具有獨立性地位的法人實體存在,法定機構(gòu)的法律規(guī)制應獲得憲制性法律——香港基本法,以及香港立法機關制定的法律(如條例)的承認。法定機構(gòu)依法設立的特質(zhì)揭示了其組織形成權(quán)由法律保留的理論基礎,此即法定機構(gòu)的合法性來源,亦是對法定機構(gòu)予以法律規(guī)制的核心內(nèi)容。香港法定機構(gòu)的職能范圍涉及教育、文化、公共交通等社會諸多領域,遵循“一機構(gòu)一立法”原則依法提供特定的公共服務,雖不對法律制定者——香港立法會負責,但接受特區(qū)政府和社會的監(jiān)督。借重香港法定機構(gòu)的治理結(jié)構(gòu)設計內(nèi)部制度、厘清外部關系具有可行性,香港法定機構(gòu)的成熟做法和經(jīng)驗對于當下中國內(nèi)地事業(yè)單位的改革具有啟示意義。以立法推進改革的深入攻堅,這是由法治社會所證實的實踐理性,亦是保障改革動力補給以及維系制度張力的有效路徑�！耙粰C構(gòu)一立法”的立法體例、法定機構(gòu)的理事會制度設計、公信力來源及保障等問題亦應依具體情況具體討論。
[Abstract]:The success of the reform of public service institutions and the role of the large marginal scope are directly related to the effectiveness of social governance. The institution reform in China to "the separation of the politics", "the separation of management" principle and purpose, has made some achievements, but the reform of the "old", "big" and "difficult" problem is always in suspense, almost in the diehard dilemma. Hongkong legal institutions since outside the framework of power in the administration, legislation and judiciary of the Hongkong Special Administrative Region, there is as prescribed by law, is independent of the status of legal entity, legal regulation of legal institutions should be given to the constitutional law, the basic law of Hongkong, and the laws of the Hongkong legislature (such as regulation) recognition. The characteristics established by the statutory institutions reveal the theoretical basis of the right to form their organization by law, which is the source of legality and the core content of legal regulation for statutory institutions. Hongkong legal institutions involving education, culture, public transportation and other social fields, follow the "agency legislation" principle to provide specific public service according to law, although not law makers -- the Hongkong Legislative Council is responsible, but to accept the government and social supervision. On the Hongkong legal organization governance structure design system, clarify the internal external relationship is feasible, Hongkong statutory bodies mature practices and experience has implications for the reform of the current Chinese mainland institutions. Promoting the reform and deepening the reform by legislation is a practical reason which is proved by the rule of law society, and also an effective way to guarantee the reform power supply and maintain the system tension. The legislative style of "one institution and one legislature", the design of the board of directors of a statutory body, the source and guarantee of credibility should also be discussed in detail.
