【摘要】：隨著社會(huì)經(jīng)濟(jì)的發(fā)展,人民生活水平的提高,汽車、摩托車等機(jī)動(dòng)車已經(jīng)在進(jìn)入尋常百姓家。由于順路,情誼關(guān)系等原因,駕駛?cè)撕靡馔擞H人、朋友、甚至是不認(rèn)識(shí)的人外出辦理事務(wù)的情形也越來越普遍。善意的駕駛?cè)耸欠裼斜匾袚?dān)受惠人的安保責(zé)任,對(duì)其權(quán)利義務(wù)又是如何限制的,責(zé)任是如何分配的等等這些目前尚不明朗的問題。因此,筆者試圖結(jié)合理論上的研究與實(shí)踐中的判例,對(duì)好意搭乘的侵權(quán)問題進(jìn)行探討,以期得到一個(gè)相對(duì)全面的論述。
[Abstract]:With the development of social economy and the improvement of people's living standards, cars, motorcycles and other motor vehicles have entered the homes of ordinary people. Because of passing by, friendship and other reasons, it is more and more common for drivers to travel out to do business with relatives, friends and even people they do not know. It is not clear whether bona fide drivers need to bear the security responsibility of the beneficiary, how to limit their rights and obligations, how the responsibility is distributed, and so on. Therefore, the author tries to discuss the tort of good intentions by combining the theoretical research with the cases in practice, in order to get a relatively comprehensive discussion.
