論我國網(wǎng)絡消費者的知情權(quán)

【摘要】:隨著市場經(jīng)濟不斷發(fā)展,公民購買力增強,互聯(lián)網(wǎng)高度普及,人們的交易方式發(fā)生了深刻變化。網(wǎng)絡交易模式在我國發(fā)展迅猛,以其方便快捷、價格低廉、種類繁多、地域限制性低等優(yōu)勢吸引著眾多消費者。網(wǎng)絡交易模式給消費者帶來實惠與方便的同時,也對我國現(xiàn)行消費者權(quán)益保護制度,特別是消費者知情權(quán)的保護制度提出了新挑戰(zhàn)。網(wǎng)絡交易處于發(fā)展的初期,其交易秩序、監(jiān)管體系尚不完備,這使得傳統(tǒng)交易模式中就處于交易弱勢地位的消費者在網(wǎng)絡交易模式下處于更加明顯的不利地位。對網(wǎng)絡消費者知情權(quán)進行深入研究,指出我國相關法律保護制度的不足之處,構(gòu)建適合我國網(wǎng)絡購物環(huán)境的交易規(guī)則和法律監(jiān)管體系,破解網(wǎng)絡消費者知情權(quán)屢受侵害的難題,,以保護網(wǎng)絡消費者的合法權(quán)益,是本文的研究意義所在。 消費者的知情權(quán)是消費者的法定權(quán)利和基本權(quán)利之一,是消費者主張其他權(quán)利的前提和基礎。本文運用了比較分析、案例分析等研究方法,研究我國現(xiàn)實生活中侵犯網(wǎng)絡消費者知情權(quán)的各種方式及其制度成因,指出我國相關法律保護制度的不足,并對未來我國網(wǎng)絡消費者知情權(quán)保護法律制度的完善提出幾點建議。 本文除去引言、結(jié)語外,共分為四個部分。第一部分是消費者知情權(quán)的基本問題。該部分從保護網(wǎng)絡消費者的主體資格入手,分析網(wǎng)絡消費者知情權(quán)的內(nèi)涵,探討保護消費者知情權(quán)的理論依據(jù)。第二部分通過對實踐中我國網(wǎng)絡消費者知情權(quán)保護存在的問題進行分析,探究導致消費者知情權(quán)受侵害的制度成因。第三部分通過比較當今世界發(fā)達國家和國際組織在保護網(wǎng)絡消費者知情權(quán)方面的先進制度,總結(jié)國外制度對保護我國網(wǎng)絡消費者知情權(quán)的啟示。 第四部分是本文的核心所在,針對網(wǎng)絡消費者知情權(quán)存在的各種問題,提出相關建議。包括擴大對網(wǎng)絡消費者知情權(quán)的保護范圍,規(guī)制消費者的反悔權(quán),增強經(jīng)營者的信息披露義務,建立有影響力的網(wǎng)絡信譽評價和安全評價系統(tǒng),建立侵犯網(wǎng)絡消費者知情權(quán)的救濟制度,切實促進網(wǎng)絡消費者知情權(quán)保護的實現(xiàn)。
[Abstract]:With the continuous development of market economy, the increasing purchasing power of citizens and the popularity of Internet, people's trading methods have undergone profound changes. The network trading model is developing rapidly in our country. It attracts many consumers because of its advantages such as convenience, low price, wide variety, low geographical restriction and so on. While the network transaction model brings benefits and convenience to consumers, it also poses a new challenge to the current consumer rights and interests protection system in our country, especially the protection system of consumers' right to know. Network transaction is in the early stage of development, its transaction order and supervision system are not complete, which makes the consumers who are in the weak position of trading in the traditional trading mode in a more obvious disadvantageous position under the network trading mode. This paper makes an in-depth study on the right to know of Internet consumers, points out the shortcomings of relevant legal protection systems in our country, constructs the transaction rules and legal supervision system suitable for our country's online shopping environment, and solves the problem that the right to know of online consumers is frequently infringed. In order to protect the legitimate rights and interests of network consumers, is the significance of this study. Consumers' right to know is one of the legal and basic rights of consumers, and is the premise and basis for consumers to claim other rights. This paper uses comparative analysis, case analysis and other research methods to study various ways and institutional causes of infringing the right to know of Internet consumers in our country's real life, and points out the deficiencies of relevant legal protection systems in China. Some suggestions are put forward to perfect the legal system of network consumer's right to know in the future. In addition to the introduction and conclusion, this paper is divided into four parts. The first part is the basic problem of consumers' right to know. This part analyzes the connotation of network consumers' right to know and discusses the theoretical basis of protecting consumers' right to know. The second part analyzes the problems existing in the protection of network consumers' right to know in practice, and probes into the causes of the infringement of consumers' right to know. In the third part, by comparing the advanced systems of the developed countries and international organizations in the protection of the right to know of the Internet consumers, the third part summarizes the enlightenment of the foreign institutions on the protection of the right to know of the Internet consumers in our country. The fourth part is the core of this paper, in view of the network consumer right to know the existence of various problems, put forward relevant suggestions. Including expanding the scope of protection of network consumers' right to know, regulating consumers' right of reneging, strengthening the duty of information disclosure of operators, and establishing an influential network credit evaluation and safety evaluation system. Establish the relief system of infringing upon network consumer's right to know, and promote the realization of network consumer's right to know.
