論“轉(zhuǎn)換性使用”與著作權(quán)合理使用制度

【摘要】:"轉(zhuǎn)換性使用"是美國合理使用判斷的重要因素,其內(nèi)涵歷經(jīng)"轉(zhuǎn)換性內(nèi)容"到"轉(zhuǎn)換性目的"的轉(zhuǎn)變。轉(zhuǎn)換性使用傾向于構(gòu)成合理使用契合立法之旨趣,順應(yīng)文化多元之面向,對廓清數(shù)字化利用之"合理性"問題甚有裨益,其更為數(shù)字時(shí)代日新月異之變化預(yù)留了合法化生存空間,應(yīng)當(dāng)與本土資源相結(jié)合,為我國司法實(shí)務(wù)和學(xué)術(shù)研究所借鑒。
[Abstract]:"transformative use" is an important factor in American rational use judgment, and its connotation has been transformed from "transformative content" to "transformative purpose". The transformative use tends to constitute the aim of reasonable use in accordance with the legislative interests, conforms to the cultural diversity, and is beneficial to the clarification of the "rationality" of digital utilization. The rapid changes in the digital age have reserved legalized living space, which should be combined with local resources and be used for reference by judicial practice and academic research institutes in our country.
