【摘要】：伴隨時代的迅速發(fā)展,在我們現(xiàn)實生活中許多現(xiàn)象及問題游走在法律之外,而同性戀現(xiàn)象及相關(guān)問題就是其中之一。據(jù)統(tǒng)計,同性戀人群大約占比人口總數(shù)的5%,這一比例的人群在不同地域和國家中始終保持在一個相對穩(wěn)定的數(shù)量。近二十年來,同性戀現(xiàn)象及問題正在被世界慢慢接受并改變,諸多西方國家通過立法給予同性伴侶相互結(jié)合的權(quán)利,而是否應(yīng)該為同性戀群體立法來保障其結(jié)合的權(quán)利以及應(yīng)該如何立法也成了世界范圍內(nèi)關(guān)注和研究的問題之一。然而在我國,同性結(jié)合的問題似乎還未被正視,相關(guān)制度及權(quán)益保障也屬空白。然而在現(xiàn)實生活中,同妻問題、同性伴侶的婚姻訴求以及有關(guān)身份和財產(chǎn)的糾紛卻一直存在著,那么,如何減少這些社會問題的發(fā)生以及是否應(yīng)該將同性戀群體的權(quán)利和義務(wù)納入法律體系中也是我國應(yīng)該思考和研究的問題之一。而本文通過分析同性戀現(xiàn)象的過去和現(xiàn)狀,研究同性結(jié)合入法的可行性和必要性,并借鑒西方國家現(xiàn)有立法技術(shù),探討適合我國同性結(jié)合的立法模式和制度,以求更好的保障這一群體的合法權(quán)益。
[Abstract]:With the rapid development of the times, many phenomena and problems walk outside the law in our real life, and homosexuality and related problems are one of them. According to statistics, gays and lesbians account for about 5 percent of the population, and the proportion of people in different regions and countries remains relatively stable. In the past two decades, the phenomenon and problems of homosexuality have been slowly accepted and changed by the world. Many western countries have passed legislation to give same-sex couples the right to combine with each other. Whether or not to legislate for the gay community to protect their right to combine and how to legislate has become one of the problems concerned and studied in the world. However, in our country, the problem of same-sex union seems to have not been faced squarely, and the relevant system and the protection of rights and interests are also blank. However, in real life, the problem of polygamy, the marriage demands of same-sex couples and the disputes about identity and property have always existed, so, How to reduce the occurrence of these social problems and whether the rights and obligations of the gay community should be incorporated into the legal system is also one of the problems that should be considered and studied in our country. By analyzing the past and present situation of homosexual phenomenon, this paper studies the feasibility and necessity of same-sex union law, and draws lessons from the existing legislative technology in western countries to explore the legislative model and system suitable for same-sex union in our country. In order to better protect the legitimate rights and interests of this group.
