【摘要】：法定離婚理由作為準予不準予離婚的法定界限，是判決離婚制度的核心。此文將我國現(xiàn)行法定離婚理由體系置于我國改革開放、社會轉型的背景之上，結合西方國家立法經(jīng)驗，對其優(yōu)點與不足進行了全面分析探討，，并提出了以破裂主義為主，兼采過錯主義、目的主義的立法原則與例示主義立法方式相結合的法定離婚理由立法構想
[Abstract]:As the legal limit of disallowing divorce, the legal divorce reason is the core of divorce judgment system. This paper puts the current legal divorce reason system on the background of reform and opening up and social transformation in our country, combining with the legislative experience of western countries, this paper makes a comprehensive analysis and discussion on its advantages and disadvantages, and puts forward the principle of rupture as the main factor. Legislative Conception of legal divorce reasons based on the combination of legislative principles of fault doctrine and objectivism and legislative mode of demonstration doctrine
