【摘要】： 非常法定夫妻財產(chǎn)制是法定夫妻財產(chǎn)制的重要組成部分,我國現(xiàn)行立法中沒有規(guī)定非常法定夫妻財產(chǎn)制。本文通過對世界各國或地區(qū)立法不同規(guī)定的比較分析和學(xué)習(xí)借鑒,首先介紹了非常法定夫妻財產(chǎn)制的概念和特征,以及我國夫妻財產(chǎn)制立法中增設(shè)非常法定夫妻財產(chǎn)制的必要性。其次,對我國的非常法定夫妻財產(chǎn)制是采取單一的宣告的非常法定夫妻財產(chǎn)制,還是采取宣告的非常法定夫妻財產(chǎn)制與當(dāng)然的非常法定夫妻財產(chǎn)制并存的雙軌制,是采取分散式立法形式還是集中式立法形式,以及是否應(yīng)當(dāng)公示進(jìn)行了探討。最后,對我國非常法定夫妻財產(chǎn)制的申請人、法定理由、效力和終止以及強制共同財產(chǎn)等具體內(nèi)容進(jìn)行了設(shè)置。
[Abstract]:The system of extraordinary legal matrimonial property is an important part of legal matrimonial property system, which is not stipulated in the current legislation of our country. This paper introduces the concept and characteristics of extraordinary legal matrimonial property system through the comparative analysis and study of different legislative provisions in various countries or regions of the world. And the necessity of adding extraordinary legal matrimonial property system in the legislation of marital property system in our country. Secondly, to our country's extraordinary legal matrimonial property system is to adopt a single declaration of extraordinary legal matrimonial property system, or to adopt the declaration of extraordinary legal marital property system and of course, the coexistence of the two systems of extraordinary legal marital property system. This paper discusses whether to adopt decentralized or centralized legislation and whether it should be publicized. Finally, the author sets up the applicant, the legal reason, the validity and the termination and the compulsory joint property of the extraordinary legal matrimonial property system in our country.
