【摘要】： 軍婚特殊保護(hù)法律制度是我國(guó)特有的法律制度,與我國(guó)自身的法律文化傳統(tǒng)息息相關(guān),有其獨(dú)有的歷史淵源,并在特定的歷史時(shí)期發(fā)揮了相應(yīng)的作用,體現(xiàn)了其存在之價(jià)值。本文通過(guò)法歷史學(xué)、比較法學(xué)、法哲學(xué)、社會(huì)學(xué)、倫理學(xué)等多種學(xué)科的研究方法,追尋軍婚特殊保護(hù)法律制度發(fā)展的軌跡,分析軍婚特殊保護(hù)法律制度在現(xiàn)代社會(huì)中所面臨的挑戰(zhàn)與存在的問(wèn)題,探討婚姻自由的價(jià)值追求和尊重婦女弱勢(shì)群體利益的理念對(duì)軍婚特殊保護(hù)法律制度所產(chǎn)生的影響。本文在比較法的框架內(nèi),對(duì)國(guó)民黨政府軍婚特殊保護(hù)立法及我國(guó)臺(tái)灣地區(qū)的軍婚特殊保護(hù)立法進(jìn)行了較為全面的考察與研究,同時(shí)對(duì)與軍婚制度相關(guān)的其它制度進(jìn)行了冷靜而理智、體系化、制度化的思考,強(qiáng)調(diào)其它相關(guān)制度對(duì)軍婚特殊保護(hù)法律制度的協(xié)調(diào)與輔助作用,建構(gòu)一個(gè)切實(shí)保護(hù)軍婚的完整體系,多角度分析現(xiàn)行軍婚特殊保護(hù)立法的不足之處、司法實(shí)踐中的弊端及所產(chǎn)生問(wèn)題的嚴(yán)重性,從而設(shè)計(jì)了完善我國(guó)軍婚民事特殊保護(hù)法律制度及軍婚刑事特殊保護(hù)法律制度的具體路徑和制度架構(gòu)。 全文共分為五章。 第一章“引言”:介紹了筆者對(duì)軍婚特殊保護(hù)“度”產(chǎn)生興趣的緣由,通過(guò)對(duì)軍婚特殊保護(hù)法律制度的現(xiàn)狀的基本描述和系統(tǒng)分析,論證了選擇“軍婚特殊保護(hù)法律問(wèn)題研究”作為論文題目進(jìn)行研究的重大理論價(jià)值和社會(huì)現(xiàn)實(shí)意義。 第二章“軍婚特殊保護(hù)法律制度探源”:婚姻法強(qiáng)調(diào)傳統(tǒng)美德,強(qiáng)化家庭倫理,其法律文化傳統(tǒng)具有漫長(zhǎng)的歷史性、繼承性,是中華法制的傳統(tǒng)法律之一,而不是舶來(lái)的法律,軍婚法律文化傳統(tǒng)及軍婚特殊保護(hù)法律制度體系也不例外。因此,本章運(yùn)用法歷史學(xué)的研究方法,通過(guò)對(duì)軍婚特殊保護(hù)法律制度演進(jìn)史的描述,分析中國(guó)軍婚特殊保護(hù)法律制度得以形成的歷史背景及發(fā)展沿革,論證了該項(xiàng)制度得以確立的歷史必然性、在該歷史環(huán)境下所起的積極作用以及進(jìn)一步發(fā)展的趨勢(shì)和方向。梳理軍婚特殊保護(hù)法律制度的歷史起點(diǎn)與歷史脈絡(luò),為學(xué)習(xí)和研究我國(guó)現(xiàn)行的軍婚特殊保護(hù)法律制度提供一些最直接的歷史經(jīng)驗(yàn)和可資借鑒的歷史資料,為軍婚特殊保護(hù)立法的修訂乃至整個(gè)軍婚特殊保護(hù)法律制度體系的改革和完善提供一種歷史視角。 第三章“軍婚特殊保護(hù)法律制度之比較研究”:本章在比較法的框架內(nèi),對(duì)國(guó)民黨政府軍婚特殊保護(hù)立法及我國(guó)臺(tái)灣地區(qū)的軍婚特殊保護(hù)立法進(jìn)行了較為全面的考察與研究。國(guó)民黨政府與根據(jù)地政府處理軍婚案件時(shí)所表現(xiàn)出的司法風(fēng)格迥異,體現(xiàn)了不同的價(jià)值取向。其軍婚特殊保護(hù)制度所折射出的戰(zhàn)時(shí)立法之思路、尊崇法治之精神及對(duì)程序正義之尊重都值得我們借鑒與吸收;同時(shí),我國(guó)臺(tái)灣地區(qū)軍婚特殊保護(hù)立法及其改革方向、對(duì)待軍婚特殊保護(hù)問(wèn)題觀念的轉(zhuǎn)變以及立足現(xiàn)實(shí)的情勢(shì)對(duì)現(xiàn)行法律所做的修改調(diào)整,都為我國(guó)現(xiàn)行軍婚特殊保護(hù)法律制度的完善提供了有益借鑒及解決現(xiàn)實(shí)存在的諸多問(wèn)題的智慧,增強(qiáng)了我們找尋未來(lái)出路的勇氣。 第四章“軍婚民事特殊保護(hù)法律制度”:討論軍婚民事保護(hù)之立法規(guī)定及法律適用,從法哲學(xué)、倫理學(xué)的角度分析婚姻的本質(zhì)和婚姻自由原則,從社會(huì)學(xué)的角度分析社會(huì)多元化變革對(duì)軍婚的影響,從而對(duì)軍婚民事特殊保護(hù)立法的未來(lái)發(fā)展提出可行性的建議,為完善我國(guó)的軍婚民事特殊保護(hù)設(shè)計(jì)了具體路徑和制度架構(gòu)。 第五章“軍婚刑事特殊保護(hù)法律制度”:討論軍事刑事保護(hù)之立法規(guī)定及法律適用,對(duì)破壞軍婚罪的構(gòu)成要件及司法實(shí)踐中的幾個(gè)法律適用問(wèn)題進(jìn)行思索探討,對(duì)軍婚刑事特殊保護(hù)立法的未來(lái)發(fā)展進(jìn)行合理預(yù)測(cè),有針對(duì)性地提出了要在我國(guó)建立全面、系統(tǒng)的軍婚刑事特殊保護(hù)法律機(jī)制的具體建議。 結(jié)論:對(duì)全文進(jìn)行總結(jié)。 軍婚特殊保護(hù)法律制度的改革是一個(gè)系統(tǒng)的工程,涉及多個(gè)社會(huì)領(lǐng)域。由于主觀上受本人學(xué)識(shí)和能力所限,客觀上在調(diào)查研究、資料收集方面尚且存在一些困難,以致不可能窮盡該問(wèn)題的方方面面,思考問(wèn)題的角度和建議也不免有諸多膚淺、不成熟之處。但對(duì)該問(wèn)題的研究興趣和熱情促使我不惜投入大量時(shí)間和精力,竭盡所能使之完善。希望本人的思考與研究能有助于解決軍人配偶一方“離婚難”的問(wèn)題以及軍人“婚戀苦”的問(wèn)題,并對(duì)推動(dòng)軍婚特殊保護(hù)法律制度的有效改革、促進(jìn)軍婚特殊保護(hù)法律制度的完善有所裨益。
[Abstract]:The legal system of special protection of military marriage is a unique legal system in our country, which is closely related to our own legal and cultural traditions, has its unique historical origins, and has played a corresponding role in a specific historical period, reflecting its value of existence. In this paper, the author analyzes the challenges and problems faced by the legal system of special protection of military marriage in modern society, and explores the impact of the value pursuit of marriage freedom and the concept of respecting the interests of vulnerable groups of women on the legal system of special protection of military marriage. Within the framework of comparative law, this paper makes a comprehensive investigation and Study on the legislation of special protection of military marriage of the Kuomintang government and the legislation of special protection of military marriage in Taiwan. At the same time, it makes a calm, rational, systematic and institutionalized reflection on other systems related to military marriage, and emphasizes the special protection of military marriage by other relevant systems. The coordination and supplementary function of the legal system is to construct a complete system of practical protection of military marriages. The deficiencies of the current legislation on special protection of military marriages, the drawbacks in judicial practice and the seriousness of the problems arising therefrom are analyzed from various angles. Thus, the legal system of civil special protection of military marriages and the legal system of criminal special protection of military marriages in China are designed and perfected. Chapter 1 "Introduction": Introduces the reason why the author is interested in the "system" of special protection of military marriage. Chapter II "Exploration of the Legal System of Special Protection of Military Marriage": Marriage Law stresses traditional virtues and strengthens family ethics. Its legal and cultural tradition has a long history and inheritance. It is one of the traditional laws of the Chinese legal system, not an imported law. The legal and cultural tradition of military marriage and the legal system of special protection of military marriage are no exception. By using the method of legal history, this chapter describes the evolution history of the legal system of special protection of military marriage, analyzes the historical background and evolution of the formation of the legal system of special protection of military marriage in China, demonstrates the historical inevitability of its establishment, its positive role in this historical environment and its further development. This paper combs the historical starting point and historical context of the legal system of special protection of military marriages, provides some most direct historical experience and historical data for studying and studying the current legal system of special protection of military marriages in China, and provides amendments to the legislation of special protection of military marriages and even the whole legal system of special protection of military marriages. The paper puts forward feasible suggestions and designs specific paths and institutional framework for improving the special protection of military marriage in China.
Chapter V "Legal System of Special Protection of Military Marriage Criminal Law": Discussing the Legislative Provisions and Legal Application of Military Criminal Protection, pondering and discussing the constituent elements of the crime of sabotaging military marriage and several legal application problems in judicial practice, reasonably predicting the future development of the legislation of special protection of military marriage criminal, and putting forward the important points pertinently To establish a comprehensive and systematic legal proposal for the special protection of military marriage crimes in China.

The reform of the legal system for special protection of military marriages is a systematic project involving many social fields. Effective reform will help to improve the legal system for the special protection of military marriages.
