法律口譯初探 ——法庭口譯及合同談判口譯比較研究

隨著中國經濟的迅猛發(fā)展,中國法院開始越來越多地接觸涉外案件,中國企業(yè)與外國主體之間的業(yè)務往來也日漸頻繁。法庭口譯和合同談判口譯(法律口譯)作為口譯的一個新起分支自然成為人們關注的焦點。本世紀以前,學術界對法律口譯領域少有涉足,且基本停留于對國外法庭口譯制度的簡單介紹。但自本世紀初開始,逐漸有中國學者研究這一領域,并探討法律口譯課程的設置,如對外經濟貿易大學出版社于2006年出版的杜碧玉教授的《法律口譯教程》等。本文立足于對法庭口譯和合同談判口譯的比較,力圖從兩者的異同中發(fā)現(xiàn)法律口譯的普遍規(guī)律,并提出相應的訓練方法。通過比較,我們可以發(fā)現(xiàn)這兩類法律口譯存在著諸多共同點和不同點。從口譯的工作模式上看,兩者均包含接續(xù)口譯和同聲傳譯;從口譯形式上看,兩者都分為聽譯和視譯;法庭口譯員和合同談判口譯員均需要在譯前做充分的準備工作;均需具備較好的短時記憶能力和筆記能力;均面臨口音及專業(yè)術語的挑戰(zhàn)等等。而其不同點在于:口譯側重點不同,為維護庭審秩序的嚴肅性,法庭口譯側重于程序,而合同談判口譯則側重于雙方交談的內容以促進協(xié)議的達成;口譯員的角色不同,從某種意義上講法庭口譯員比合同談判口譯員更專業(yè),所負的...
