【摘要】：本文通過對大陸法系、英美法系及《國際貨物銷售代理公約》有關代理制度之比較,闡述了我國現(xiàn)行外貿(mào)代理制度的不足。與此同時,本文通過對今年所頌布的新《合同法》有關條款的分析,闡明了《合同法》對我國外貿(mào)代理制度所作出的貢獻:1- 彌補了原外貿(mào)代理制度法律效力不足;2- 拓寬了《民法通則》的代理內(nèi)函;3- 平衡了外貿(mào)代理中當事人間的權利義務
[Abstract]:By comparing the agency systems of continental law system, Anglo-American law system and the Convention on the International Sale of goods, this paper expounds the shortcomings of the current foreign trade agency system in China. At the same time, through the analysis of the relevant provisions of the new contract Law which was published this year, this paper clarifies the contribution of the contract Law to the foreign trade agency system of our country: (1) it makes up for the lack of legal effectiveness of the original foreign trade agency system; 2-broadening the agency letter of the General principles of Civil Law; 3-balancing the rights and obligations of the parties in the foreign trade agency
