【摘要】：“無權處分”問題自合同法頒布實施以來一直成為學者們普遍關注的焦點 ,學界圍繞無權處分的效力這一核心問題展開了熱烈的討論 ,但至今未成定見。無權處分問題之所以被王澤鑒先生形象地比喻為“法學上的精靈” ,困擾理論和實務界數十年之久 ,肇因于該問題本身的復雜性及其與相關民法制度安排的和諧共恰與邏輯一致。在民法理論上 ,無權處分涉及物權行為與債權行為相分離的重大理論問題 ,在調整對象及所涉民法領域方面也牽扯眾多 ,擬就無權處分的一些基本理論問題對學界的代表性觀點作一簡要整理和綜述 ,同時提出一些觀點
[Abstract]:The issue of "unauthorized disposition" has been the focus of attention of scholars since the promulgation and implementation of contract law. The academic circles have carried out a heated discussion on the core issue of the effectiveness of unauthorized disposition, but no firm views have been reached yet. The reason why the issue of unauthorized disposition has been figuratively likened by Mr. Wang Zejian to "the Elf of Law" has troubled the theoretical and practical circles for decades. The reason lies in the complexity of the problem itself and its harmony and logic with the arrangement of the relevant civil law system. In the theory of civil law, the unauthorized disposition involves the separation of the act of real right and the act of creditor's rights, and it also involves a lot in the aspects of the object of adjustment and the field of civil law involved. This paper intends to make a brief arrangement and summary of the representative viewpoints of academic circles on some basic theoretical issues of unauthorized disposition, and at the same time puts forward some points of view.
