房屋租賃合同解除法律問題研究

【摘要】:近年來,隨著我國社會(huì)經(jīng)濟(jì)的不斷發(fā)展和進(jìn)步,房地產(chǎn)市場日益升溫,由此催生的房地產(chǎn)租賃業(yè)務(wù)逐年增加,從而導(dǎo)致房屋租賃合同糾紛案件也日益增多,其中關(guān)于房屋租賃合同的解除問題占有較大的比重。2009年7月30日,《最高人民法院關(guān)于審理房屋租賃合同糾紛案件具體應(yīng)用法律若干問題的解釋》正式公布并施行,對各級(jí)人民法院正確審理房屋租賃合同糾紛案件發(fā)揮積極的指導(dǎo)作用,使房屋租賃合同解除的法律制度也日趨于完善。但是有關(guān)房屋租賃合同的解除在具體的審判實(shí)踐中仍不斷出現(xiàn)諸多的新情況、新問題,存在不少的爭議。 帶著以上的問題,結(jié)合有關(guān)學(xué)者的不同觀點(diǎn),本文重點(diǎn)分析了以下幾個(gè)方面問題,首先,介紹了房屋租賃合同解除的概念,并歸納出房屋租賃合同解除所具有的四個(gè)特點(diǎn)。其次,介紹了房屋租賃合同解除權(quán)的行使事由。在房屋租賃合同中,根據(jù)解除權(quán)發(fā)生的依據(jù)不同,可分為約定解除權(quán)、合意解除權(quán)和法定解除權(quán)。本文在該部分重點(diǎn)論述了房屋租賃合同法定解除權(quán)的行使事由,具體包括不可抗力、情勢變更、根本違約以及房屋租賃合同中法定解除的一些特殊規(guī)定。再次,介紹了房屋租賃合同解除權(quán)的行使程序。主要包括房屋租賃合同解除權(quán)的行使主體、行使方式和行使期間。有關(guān)房屋租賃合同解除權(quán)的行使期間問題,筆者援引了自身在司法實(shí)踐中審理的房屋租賃合同解除的典型案例,并結(jié)合相關(guān)的理論及學(xué)者的觀點(diǎn)探討了房屋租賃合同解除權(quán)行使期間的屬性及開始時(shí)間和消滅時(shí)間,通過這種理論與司法實(shí)踐相結(jié)合的分析,使問題更加具體明晰。最后,介紹了房屋租賃合同解除權(quán)的行使效力。在該部分中筆者通過對一個(gè)具有代表性的案例進(jìn)行詳盡的分析論證,,最終以案說法,論述了有關(guān)房屋租賃合同解除后的裝飾裝修等添附及殘值可根據(jù)承租人的裝飾裝修是否經(jīng)過出租人同意以及裝飾裝修是否構(gòu)成附合予以不同的處理。同時(shí),通過該案例,筆者提出了對于房屋租賃合同解除后可得利益損失應(yīng)予賠償?shù)挠^點(diǎn)。
[Abstract]:In recent years, with the continuous development and progress of our country's social economy, the real estate market is heating up day by day. On July 30, 2009, the interpretation of the Supreme people's Court on the specific Application of Law in the trial of disputes over Housing Lease contracts was officially promulgated and implemented. It will play an active role in guiding the people's courts at all levels to correctly handle disputes over housing lease contracts and make the legal system for the dissolution of housing lease contracts more and more perfect day by day. However, there are still many new situations and new problems in the specific trial practice. With the above problems, combined with the different viewpoints of the scholars, this paper focuses on the following aspects: firstly, the concept of the termination of the housing lease contract is introduced, and the four characteristics of the termination of the housing lease contract are summarized. Secondly, it introduces the exercise of the right to rescind the house lease contract. In the house lease contract, according to the different basis of the right of rescission, it can be divided into the right of agreed dissolution, the right of consensual dissolution and the right of legal dissolution. In this part, the author focuses on the reasons for the exercise of the legal right of rescission of the house lease contract, including force majeure, change of circumstances, fundamental breach of contract and some special provisions of the legal rescission in the house lease contract. Thirdly, it introduces the exercise procedure of the right to rescind the house lease contract. Mainly including the exercise of the right to rescind the housing lease contract, the exercise of the mode and exercise period. On the issue of the period during which the right to rescind the house lease contract is exercised, the author invokes the typical case of the termination of the house lease contract tried by himself in judicial practice. Combined with relevant theories and scholars' views, this paper probes into the attributes, the beginning time and the time of extinction during the exercise of the right to rescind the house lease contract. Through the analysis of the combination of this theory and judicial practice, the problem becomes more specific and clear. Finally, it introduces the effect of the right to rescind the house lease contract. In this part, the author through a representative case for detailed analysis and argumentation, finally with the case, This paper discusses the addition and residual value of decoration and decoration after the termination of the lease contract, which can be dealt with differently according to whether the lessee's decoration is agreed by the lessor and whether the decoration constitutes attachment. At the same time, through this case, the author puts forward the viewpoint that the loss of interest after the termination of the house lease contract should be compensated.
