【摘要】：近期國家出臺了一系列勞務(wù)派遣法律法規(guī),從2013年修訂的《勞動(dòng)合同法》、《勞務(wù)派遣行政實(shí)施許可辦法》,到2014年1月出臺的《勞務(wù)派遣暫行規(guī)定》,都是旨在規(guī)范勞務(wù)派遣用工行為,維護(hù)被派遣勞動(dòng)者的合法權(quán)益。目前銀行在各類崗位使用勞務(wù)派遣用工等非勞動(dòng)合同用工情形大量存在,本文擬通過解讀法律法規(guī),提出應(yīng)對策略,指導(dǎo)銀行防范勞務(wù)派遣用工及業(yè)務(wù)外包中的法律風(fēng)險(xiǎn)。
[Abstract]:Recently, the state has issued a series of labor dispatch laws and regulations, From the revised Labor contract Law in 2013, the Administrative Licensing measures of Labor dispatching, to the interim provisions on Labor dispatching issued in January 2014, all of them are aimed at standardizing the employment behavior of labor dispatch and safeguarding the legitimate rights and interests of dispatched workers. At present, there are a large number of non-labor contract employment cases such as the employment of labor dispatch in various kinds of posts. This paper intends to interpret the laws and regulations, put forward countermeasures to guide banks to guard against the legal risks in labor dispatch and outsourcing.
