【摘要】：正3月21日,圍繞《關(guān)于審理道路交通事故賠償案件適用法律若干問(wèn)題的解釋》(簡(jiǎn)稱(chēng)《解釋》),最高人民法院正式對(duì)外公布征求意見(jiàn)稿,邀請(qǐng)社會(huì)各界提出具體修改建議并說(shuō)明理由。該解釋根據(jù)《中華人民共和國(guó)侵權(quán)責(zé)任法》、《中華人民共和國(guó)道路交通安全法》、《中華人民共和國(guó)保險(xiǎn)法》、《中華人民共和國(guó)合同法》、《中華人民共和國(guó)民事訴訟法》等法律的規(guī)定,結(jié)合民事審判實(shí)踐制定,其中三條涉及公路部門(mén)的司法解釋引發(fā)
[Abstract]:On March 21, the Supreme people's Court officially published the draft of the solicitation of opinions on the interpretation of certain issues concerning the applicable Law applicable to the trial of compensation cases for Road Traffic Accidents (abbreviated as "interpretation"). Invite all walks of life to put forward concrete modification suggestion and explain the reason. The interpretation is based on the provisions of the Law of the people's Republic of China on Tort liability, the Law on Road Traffic Safety of the people's Republic of China, the Insurance Law of the people's Republic of China, the contract Law of the people's Republic of China, the Civil procedure Law of the people's Republic of China, etc. Combined with the practice of civil trial, three of the articles are related to the judicial interpretation of the highway department.
