【摘要】:通過分析我國(guó)企業(yè)當(dāng)前所面臨的機(jī)遇,本文分類探討了外派員工制度存在的一些問題。借由與類似概念的對(duì)比,筆者詳細(xì)梳理了制度內(nèi)部存在的法律關(guān)系,并提出完善該制度的個(gè)人意見。 第一章主要闡述中國(guó)企業(yè)外派員工的背景。社會(huì)背景主要從金融危機(jī)給我國(guó)企業(yè)“走出去”戰(zhàn)略帶來的機(jī)遇角度入手,介紹“走出去”戰(zhàn)略對(duì)我國(guó)企業(yè)發(fā)展的重要意義;理論背景重點(diǎn)介紹外派員工的特殊性,例如:身份的雙重性、工作的跨地域性、群體的支持性等。 第二章著力探討外派員工制度的現(xiàn)狀及其中存在的問題。站在法學(xué)的角度對(duì)這些問題的癥結(jié)所在進(jìn)行分析和研究,結(jié)合典型案例之間的對(duì)比作出歸納總結(jié)。 第三章重點(diǎn)從合同法、勞動(dòng)法、國(guó)際法三個(gè)部門法結(jié)合的角度釋明外派員工制度與其他相關(guān)制度的區(qū)別,通過實(shí)踐案例的分析揭示存在于外派員工制度中的特有問題和解決方法。 第四章提出對(duì)完善我國(guó)外派員工相關(guān)法律制度的構(gòu)想。在前文分析的基礎(chǔ)上,從理論和實(shí)踐兩方面提出完善建議。 第五部分結(jié)語總結(jié)全文。
[Abstract]:By analyzing the opportunities faced by Chinese enterprises at present, this paper classifies and discusses some problems existing in the expatriate staff system. By comparing the reasons with similar concepts, the author makes a detailed analysis of the legal relations existing within the system. And put forward the individual opinion that consummates this system. The first chapter mainly expounds the background of Chinese enterprises' expatriate staff. The social background mainly starts with the opportunity angle that the financial crisis brings to our enterprises'"going out" strategy, and introduces the important significance of "going out" strategy to the development of our country's enterprises. The theoretical background focuses on the particularity of expatriate staff, such as dual identity, cross-regional work, group support and so on. The second chapter focuses on the status quo of expatriate staff system and the existing problems. From the point of view of law, this paper analyzes and studies the crux of these problems, and summarizes the comparison between typical cases. The third chapter focuses on explaining the differences between the expatriate staff system and other related systems from the angle of the combination of contract law, labor law and international law. Through the analysis of practical cases, it reveals the unique problems and solutions in the expatriate staff system. Chapter 4th puts forward the idea of perfecting the related legal system of expatriate staff in our country. On the basis of the previous analysis, the author puts forward some suggestions from two aspects of theory and practice. Part 5th summarizes the full text of the conclusion.
