基于理論模型的研究發(fā)現(xiàn),<勞動合同法>有助于知識員工和知識密集型企業(yè)達(dá)成"雙贏",但是可能導(dǎo)致體力員工和勞動密集型企業(yè)"雙輸".<勞動合同法>之所以備受爭議,其對低端勞工市場的消極影響是主因,外界經(jīng)濟(jì)環(huán)境惡化帶來的經(jīng)營壓力和就業(yè)壓力是輔因,而且,主輔因的結(jié)合打亂了政府預(yù)期的經(jīng)濟(jì)轉(zhuǎn)型之路.
Abstract:
The research based on theoretical model indicates that Labor Contract Law will bring "winwin" to knowledge workers and knowledge-intensive firms and "loss-loss" to manual workers and labor-intensive firms. The reasons why Labor Contract Law is on fierce debate are mainly attributed to its negative influences on low-end labor market; besides, companies' operation plights and workers' employment problems, both of which are associated with the worsen of external economic conditions, have their own subsidiary effects. What's more, the plan for economic transformation is disturbed when those two effects combine.
