【摘要】："毒駕"問題日益嚴重,學(xué)界呼喚"毒駕"入刑的聲音也越來越大。由于"毒駕"與"醉駕"有著某種程度的相似處,隨著"醉駕"入刑的效果日益凸顯,效仿"醉駕"給"毒駕"立法的建議似乎變得可行。然而,通過對西方主要發(fā)達國家尤其是美國的"毒駕"立法進程的研究顯示,"毒駕"問題之復(fù)雜遠超"醉駕",立法理念、科學(xué)技術(shù)、現(xiàn)實需求等多重因素制約著"毒駕"問題的研究,也給立法帶來了巨大的挑戰(zhàn)。在毒品日趨泛濫的今天,給"毒駕"立法對于我國已經(jīng)是迫在眉睫的問題了,適度借鑒國外成功經(jīng)驗,吸取失敗教訓(xùn),對我們順利實現(xiàn)"毒駕"入刑,有效打擊"毒駕"行為,遏制藥物濫用絕對是大有裨益的。
[Abstract]:"The problem of drug-driving" has become more and more serious, and the sound of "drug-driving" is becoming more and more important in the academic field. As the result of the "drunk driving" has a certain degree of similarity, as the effect of the "drunk driving" has become more and more prominent, the suggestion of "driving the drug-driving" legislation appears to be feasible. However, through the study of the "drug-driving" legislative process in the western major developed countries, especially the United States, the study on the problem of "driving the drug-driving" by the "complicated and far-drunk driving of the problem", the legislative concept, the science and technology, the real demand and so on, has brought great challenges to the legislation. In the present day, the "drug-driving" legislation has become an urgent problem for our country, and it is of great benefit for us to learn from the successful experiences of the foreign countries and to absorb the failure lessons.
