【摘要】：法律規(guī)則的來源是什么,法律規(guī)則以什么為基礎(chǔ),是人類進入軸心時代以來討論的永恒主題。傳統(tǒng)的哲學(xué)家以思辨的方法從多方面討論了人的本性,得出法律的規(guī)則來源于人,來源于人的本性�，F(xiàn)代心理學(xué)的三次思潮則運用實證的手段,對人性的討論更具科學(xué)性。從對人性的討論并結(jié)合法律構(gòu)成的基本要素分析可以得出,法律規(guī)則的設(shè)定關(guān)鍵在于約束人、發(fā)展人、實現(xiàn)人的自由個性,法律應(yīng)以人為基礎(chǔ)。
[Abstract]:What is the origin of the rule of law, what is the basis of the rule of law is the eternal theme that has been discussed since the time when mankind entered the axis of the axis. The traditional philosophers have discussed the nature of the human from various aspects by the way of thinking, and the rule of the law comes from the human nature and comes from the human nature. The third thoughts of modern psychology use the means of demonstration, and the discussion of human nature is more scientific.
