【摘要】：人大主導(dǎo)立法是我國(guó)憲法的基本原則和立法體制的核心要義。黨的十八屆四中全會(huì)和《立法法》新修訂之后,實(shí)現(xiàn)有立法權(quán)的人大對(duì)立法過程的主導(dǎo)遂成為各級(jí)立法工作的基本目標(biāo)與中心任務(wù)。當(dāng)前,在思想認(rèn)識(shí)上對(duì)人大主導(dǎo)立法還存在諸多誤區(qū),立法實(shí)踐中對(duì)"誰(shuí)來主導(dǎo)人大立法""什么是人大主導(dǎo)"以及"人大如何主導(dǎo)立法"等問題還存在困惑。鑒于此,有必要對(duì)人大主導(dǎo)立法的認(rèn)識(shí)誤區(qū)進(jìn)行理論糾偏,對(duì)"人大主導(dǎo)立法"從概念內(nèi)涵、主體和對(duì)象上進(jìn)行科學(xué)界定,并在此基礎(chǔ)之上提出實(shí)現(xiàn)人大主導(dǎo)立法的若干路徑。
[Abstract]:The leading legislation of the National people's Congress is the basic principle of our constitution and the core meaning of the legislative system. After the fourth Plenary session of the 18th CPC Central Committee and the new revision of the Legislative Law, the realization of the leading role of the people's Congress with legislative power in the legislative process has become the basic goal and central task of legislative work at all levels. At present, there are still many misunderstandings about the legislation led by the people's Congress in the ideological understanding, and there are still puzzles in the legislative practice about "who will lead the legislation of the people's Congress", "what is the leading legislation of the people's Congress" and "how the people's Congress leads the legislation". In view of this, it is necessary to correct the misunderstanding of the leading legislation of the National people's Congress in theory, define the concept connotation, subject and object of the leading legislation of the National people's Congress scientifically, and on this basis, put forward some ways to realize the leading legislation of the National people's Congress.
