【摘要】：正我們之所以如此重視權(quán)利理論的研究,無疑是基于權(quán)利(廣義上也包括"人權(quán)")的極端重要性。權(quán)利及其法律制度是人類安排社會關(guān)系、社會秩序與個人生活的一件杰作。至少在現(xiàn)代的人類社會生活之中,"權(quán)利概念無處不在,它在我們的思維習慣中根深蒂固,以至于不能想象沒有它會怎么樣"([美]理查德·達格爾:《權(quán)利》,載[美]特倫斯·鮑爾等編:《政治創(chuàng)新與概念變革》,朱進東譯,譯林出版社2013年版)。而它最重要的價值,就像范伯格所言,"擁有權(quán)利能使我們‘像人一樣地站立起來'能夠與他人直接進行對視,并且在某種根本的方面感受到每個人的平等……而所謂的‘人的尊嚴'可能就是人們所承
[Abstract]:The reason why we attach so much importance to the theory of rights is undoubtedly based on the extreme importance of rights (including human rights in a broad sense). Rights and their legal systems are a masterpiece of human arrangements for social relations, social order and personal life. At least in modern human life, "the concept of right is so pervasive that it is so deep-rooted in our habits of thinking that we cannot imagine what would have happened without it" ([beauty] Richard Dagel: "right"). And its most important value, as Feinberg put it, "having a right allows us to 'stand up like human beings' to be able to look directly at others and feel the equality of everyone in some fundamental way. And the so-called 'human dignity' may be what people inherit.
