【摘要】：法律文書名詞的研究,具有重要的法學(xué)及文書學(xué)、檔案學(xué)意義,但目前相關(guān)研究尚處于空白狀態(tài)。我國(guó)當(dāng)代法律文書名詞分別來(lái)源于繼承、移植和自創(chuàng),文章研究?jī)?nèi)容為繼承部分,包括古代與近代法律文書名詞繼承兩個(gè)方面。源于古代和近代的法律名詞在當(dāng)代法律文書名詞體系中多為基礎(chǔ)性名詞并常出現(xiàn)在訴訟程序中,隨著法制的不斷發(fā)展,現(xiàn)今基于這些名詞衍生出一些法律文書詞語(yǔ),逐漸形成枝狀系統(tǒng)。
[Abstract]:The research on the nouns of legal documents is of great significance in law, philology and archival science, but at present the relevant research is still in a blank state. The nouns of contemporary legal documents in China come from inheritance, transplantation and self-creation, respectively. The content of this article is inheritance, including the inheritance of nouns in ancient and modern legal documents. Legal nouns originated in ancient and modern times are mostly basic nouns in the nouns system of contemporary legal documents and often appear in litigation procedures. With the continuous development of the legal system, some words of legal instruments are derived from these nouns nowadays. Gradually forming a branching system.
