【摘要】：韓非的學(xué)術(shù)思想是中國(guó)法律文化的一個(gè)重要紐結(jié)。從韓非學(xué)術(shù)思想的演進(jìn)歷程來(lái)看,少年時(shí)代的韓非主要學(xué)習(xí)申不害之學(xué),創(chuàng)作《和氏》篇,是為韓非學(xué)術(shù)思想的起點(diǎn)。青年時(shí)代的韓非精研黃老道家的思想,創(chuàng)作《解老》、《喻老》。中年時(shí)代的韓非師事于荀子,受荀子的影響,創(chuàng)作《奸劫?gòu)s臣》、《楊權(quán)》等篇。在韓桓惠王末年與韓王安時(shí)代,壯年時(shí)代的韓非創(chuàng)作《有度》、《愛(ài)臣》、《忠孝》及《飾邪》諸篇,以之作為"諫韓王書(shū)",體現(xiàn)了當(dāng)下所說(shuō)的"研以致用"的追求。公元前234年,年過(guò)六旬的韓非進(jìn)入晚年,他出使秦國(guó),創(chuàng)作了《存韓》、《初見(jiàn)秦》,并以《難言》作為絕筆之作。歷史性地理解韓非學(xué)術(shù)思想的起點(diǎn)、深化、拓展與定格,是全面理解韓非學(xué)術(shù)思想的必要環(huán)節(jié),是深入闡述中國(guó)法律文化的必要準(zhǔn)備。
[Abstract]:Han Fei's academic thought is an important knot of Chinese legal culture. From the view of the evolution of Han Fei's academic thought, the academic thought of Han Fei in his youth was the starting point of the academic thought of Han Fei. Han Fei, as a young man, studied the thought of Huanglao Taoism, and created "decommissioning the elderly" and "Yu Lao". In middle age, Han Fei worked for Xunzi, influenced by Xunzi, and wrote "robbing and killing officials", "Yang Quan" and so on. In the late years of Han Huanhui and Han Wang an, Han Fei in his prime period wrote "degree", "Love Minister", "loyalty and filial piety" and "deceiving evil", which was regarded as "remonstrating Han Wang Shu", which reflected the pursuit of "studying and using". In 234 BC, Han Fei, over 60 years old, entered his later years, and he sent out to the Qin state to create "the Republic of Korea", "first see the Qin", and took "difficult words" as his masterpiece. To understand the starting point, deepening, expanding and fixing of Han Fei's academic thought is the necessary link of understanding the academic thought of Han Fei in an all-round way, and is the necessary preparation to expound the Chinese legal culture in depth.
