【摘要】：對(duì)于中國(guó)傳統(tǒng)法律文化的研究,時(shí)至今日,在不少方面已經(jīng)取得了很大的成就。但遺憾的是,到現(xiàn)在為止,還沒(méi)有人對(duì)傳統(tǒng)法律文化從法概念的角度做出專(zhuān)題研究�；诖�,筆者在收集資料,總結(jié)前人相關(guān)研究成果的基礎(chǔ)上,對(duì)于傳統(tǒng)法律中的法概念做一專(zhuān)題研究。筆者相信,這一研究有其必要性,亦有其理論和現(xiàn)實(shí)的意義。 在論文的第一部分,筆者討論了中國(guó)古代“法”概念的不同內(nèi)涵,具體而言,中國(guó)古代“法”概念有“準(zhǔn)則”、“法度”和“刑法”三層含義。在認(rèn)識(shí)中國(guó)古代“法”概念不同內(nèi)涵的基礎(chǔ)上,論文的第二部分概括出了它的特點(diǎn)并對(duì)其進(jìn)行研究,古代“法”概念具有工具性、依附性、公意、公平性和穩(wěn)定性等特點(diǎn)。在論文的第三部分即最后一部分,論文對(duì)中國(guó)古代“法”概念與傳統(tǒng)法的關(guān)系進(jìn)行探討,中國(guó)古人對(duì)“法”的認(rèn)識(shí)和理解,影響著傳統(tǒng)法律的各個(gè)方面。具體而言,中國(guó)傳統(tǒng)法律的制定、適用以及中國(guó)古代社會(huì)的法律觀與“法”概念有著密切的關(guān)系。
[Abstract]:To this day, great achievements have been made in many aspects of the study of Chinese traditional legal culture. Unfortunately, up to now, no one has made a special study on the traditional legal culture from the perspective of the concept of law. Based on this, the author makes a special research on the concept of law in traditional law on the basis of collecting data and summarizing the related research results. The author believes that this research has its necessity, but also its theoretical and practical significance. In the first part of the paper, the author discusses the different connotations of the concept of "law" in ancient China. Specifically, the concept of "law" in ancient China has three meanings: "criterion", "law" and "criminal law". On the basis of understanding the different connotations of the concept of "law" in ancient China, the second part of the paper generalizes its characteristics and studies it. The concept of "law" in ancient times has the characteristics of instrumentality, dependence, common will, fairness and stability. In the third and last part of the paper, the relationship between the concept of "law" and traditional law in ancient China is discussed. The understanding and understanding of "law" in ancient China affect all aspects of traditional law. Specifically, the formulation and application of Chinese traditional law and the legal concept of ancient Chinese society are closely related to the concept of "law".
