【摘要】：瞿同祖先生在《中國(guó)法律與中國(guó)社會(huì)》中認(rèn)為,家族和階級(jí)是中國(guó)傳統(tǒng)法律的主要特征表現(xiàn),本質(zhì)上也就是一種國(guó)家所制定的身份法,各安其位,各適其法。基于此,以《中國(guó)法律與中國(guó)社會(huì)》這一文本為分析基點(diǎn),從中國(guó)傳統(tǒng)"刑不上大夫,禮不下庶人"視角出發(fā),探討傳統(tǒng)法律實(shí)踐的差等性。
[Abstract]:In "Chinese Law and Chinese Society", qu Tongzu holds that family and class are the main characteristics of Chinese traditional law, which is essentially a kind of identity law formulated by a country. Based on this, based on the text of "Chinese Law and Chinese Society", this paper discusses the difference of traditional legal practice from the perspective of Chinese traditional "punishment is not on the doctor, courtesy is not below the common man".
