【摘要】：清代出現(xiàn)了大量的法律歌訣,形成了獨(dú)特的律學(xué)流派——歌訣派。所謂法律歌訣,指以傳播法律知識(shí)、法律適用經(jīng)驗(yàn),記誦法律條文為目的而編制的詩(shī)歌與口訣的總稱(chēng),其起源非常久遠(yuǎn)。張斐"注律表"對(duì)晉律特點(diǎn)的概括可看成是法律歌訣之濫觴,但其大規(guī)模的出現(xiàn)應(yīng)在明清時(shí)期。明代法律歌訣主要出現(xiàn)在坊間類(lèi)書(shū)中,屬通俗性歌訣;清代出現(xiàn)了眾多律注型歌訣,屬專(zhuān)業(yè)性歌訣。法律歌訣的出現(xiàn)使得律學(xué)向著更簡(jiǎn)便、實(shí)用的方向發(fā)展,對(duì)法律知識(shí)的傳播起到了很大推動(dòng)作用。
[Abstract]:In the Qing Dynasty, there appeared a large number of legal songs, forming a unique school of law-the school of songs. The so-called legal lyric, refers to the dissemination of legal knowledge, law application experience, recitation of legal provisions for the purpose of the compilation of poetry and the general name of the formula, its origin is very long. Zhang Fei's "annotating Law Table" can be regarded as the origin of the legal songs, but its large-scale appearance should be in the Ming and Qing dynasties. The legal songs of Ming Dynasty mainly appeared in books of various kinds, which belonged to popular songs; in Qing Dynasty, there were many kinds of legal songs, which belonged to professional ones. The emergence of legal songs makes the study of law more convenient and practical, and plays a great role in promoting the dissemination of legal knowledge.
