地方立法公眾參與的因應(yīng)之策

【摘要】：法的正當(dāng)性在于民意的體現(xiàn),參與是利益的表達(dá)與實現(xiàn)。地方立法公眾參與是立法民主化的重要體現(xiàn),有利于增強(qiáng)地方立法的民主性、正當(dāng)性,監(jiān)督公權(quán)力運行,廣泛吸納公眾參與地方立法能提升立法的公眾認(rèn)同,提高地方立法的質(zhì)量和效益。但作為參與式民主表現(xiàn)的公眾參與制度,在當(dāng)前立法語境下,尚存在諸多缺陷。健全立法公開制度,完善立法聽證制度以及建立良好的公眾參與反饋機(jī)制,使立法機(jī)關(guān)能廣泛聽取民意、公眾有序有效參與立法過程,充分整合不同利益主體的訴求,是推進(jìn)地方立法民主,保障公民權(quán)利,協(xié)調(diào)立法利益的主要途徑。
[Abstract]:The legitimacy of law lies in the embodiment of public opinion, and participation is the expression and realization of interests. Public participation in local legislation is an important embodiment of the democratization of legislation, which is conducive to enhancing the democracy and legitimacy of local legislation, supervising the operation of public power, and extensively absorbing public participation in local legislation to promote the public identity of legislation. Improve the quality and efficiency of local legislation. However, the system of public participation, as a manifestation of participatory democracy, still has many defects in the current legislative context. Improve the system of legislative publicity, perfect the system of legislative hearing and establish a good feedback mechanism of public participation, so that the legislature can extensively listen to public opinion, the public can participate in the legislative process in an orderly and effective manner, and fully integrate the demands of different stakeholders. It is the main way to promote the democracy of local legislation, protect the rights of citizens and coordinate the interests of legislation.
