犯罪與懲罰:柏拉圖《法律篇》第九卷探微

【摘要】:《法律篇》第九卷的主題是犯罪與懲罰,本論文試圖以第九卷作為切入點(diǎn),不僅探討柏拉圖所規(guī)定的各種罪名和刑罰,而且深究它們所賴以為憑的思想根據(jù)。當(dāng)諸類罪名與刑罰的表現(xiàn)形態(tài)得以呈現(xiàn),思想基礎(chǔ)得以展露,那么,將會(huì)洞察到柏拉圖如何將人性、法律、城邦政體三者完美結(jié)合起來(lái)。在柏拉圖看來(lái),靈魂秩序的混亂是犯罪的根源,無(wú)人自愿為罪,犯罪是一種不幸,故懲罰之目的不再于報(bào)復(fù),而是診療患病的靈魂,使人歸善。高尚的靈魂造就正義的城邦,公民德性的培養(yǎng),除了教化之外,還倚賴于法律對(duì)失范的行為進(jìn)行規(guī)訓(xùn)與懲罰。故法律不是僵死的教條,而是根植于城邦政體與人性之中。政治與法律是天然的孿生兄妹,這是柏拉圖給世人的教誨。 全文有由引言、正文、參考文獻(xiàn)三部分組成。其中正文分為六個(gè)章節(jié)。 引言:主要交代本文的研究方法、寫(xiě)作目的、國(guó)內(nèi)外研究的現(xiàn)狀。本論文以貼近文本閱讀的方式去理解柏拉圖的犯罪與懲罰理論《寫(xiě)作目的有二一:是通過(guò)對(duì)柏拉圖的犯罪與懲罰理論的研究,進(jìn)而可管窺古人對(duì)法律的理解,為審視古今法律之異同做準(zhǔn)備;二是從法律的視角來(lái)探究柏拉圖寫(xiě)作《法律篇》的意圖。 第一章:包括兩部分一:是介紹柏拉圖與他的對(duì)話:二是分析柏拉圖與《法律篇》,重點(diǎn)探討《法律篇》、《理想國(guó)》、《政治家》三篇對(duì)話之間的關(guān)系。 第二章:主要是研究文本。包括三方面內(nèi)容一:是探析《法律篇》的主旨:診療衰落的希臘文明;二是重點(diǎn)討論《法律篇》與第九卷關(guān)系;三是概述《法律篇》第九卷的內(nèi)容。 第三章:論述了柏拉圖的犯罪與懲罰的基本理論’該部分相當(dāng)于刑法的“總論”。討論人犯罪之原因,無(wú)人自愿為罪,懲罰之目的,以及犯罪與懲罰的神義論。 第四章:考析《法律篇》第九卷中諸類罪名和刑罰,相當(dāng)于刑法的“分則”。分別對(duì)罪名和刑罰做出考察,并闡述制定罪名和刑罰的根據(jù),包括政治、哲學(xué)、歷史觀念、文化等。 第五章:重點(diǎn)分析瀆神罪與神權(quán)政治的關(guān)系?疾鞛^神罪的神學(xué)基礎(chǔ),具體規(guī)定,以及瀆神罪對(duì)建立神權(quán)政體的關(guān)系。 結(jié)語(yǔ):概述犯罪與懲罰的性質(zhì)、基礎(chǔ),以及《法律篇》第九卷的主旨,進(jìn)而揭示《法律篇》真正寫(xiě)作意圖。 本論文總體而言有三方面的創(chuàng)新點(diǎn)。首先,在選材上說(shuō),柏拉圖的犯罪與懲罰理論,就筆者所收集的材料來(lái)看,法學(xué)界尚未有學(xué)者做專門(mén)研究,是一項(xiàng)空白的研究領(lǐng)域。其次,在研究?jī)?nèi)容上,除了探討純粹法律問(wèn)題外,還將法律置入人性、政體中來(lái)研究,突顯法律與政治的關(guān)系。最后,在研究方法上,以犯罪與懲罰作為切入點(diǎn),層層推迸,,透過(guò)諸類罪名和刑罰之規(guī)定,理解柏拉圖寫(xiě)作《法律篇》的意圖。
[Abstract]:The subject of Chapter 9 of the Law is the crime and the punishment, the thesis tries to take the ninth volume as the entry point, not only to discuss the various charges and penalties provided by Plato, but also to study the thought of them. When the types of crime and the performance of the penalty are presented and the ideological foundation is revealed, it will see how Plato can combine the human nature, the law and the state of the city perfectly. In Plato's view, the disorder of the order of the soul is the root of the crime, and the crime is a kind of misfortune. Therefore, the purpose of the punishment is no longer the revenge, but the soul of the diagnosis and treatment is the good. The noble spirit makes the city state of justice, the cultivation of the citizen's virtue, in addition to the enlightenment, also depends on the law to practice and punish the behavior of the anomie. Therefore, the law is not a dogma of deadlock, but is rooted in the state of the city and the human nature.
