【摘要】：近代以來,隨著西方法律在中國法治實(shí)踐中的問題不斷涌現(xiàn),中國開始尋求適合自身實(shí)際的法治形式,南京國民政府時(shí)期的基層調(diào)解委員會就是在追尋適合中國法治模式的基礎(chǔ)上形成的。通過對重慶及附近地區(qū)基層調(diào)解委員會的分析,可以發(fā)現(xiàn)調(diào)解委員的身份大多為地方精英,基層調(diào)解委員會工作成效也存在一定缺陷。不過,在社會關(guān)系紛繁復(fù)雜的今天,這種具有"東方智慧"的行政調(diào)解機(jī)制也能提供諸多的歷史借鑒。
[Abstract]:Since modern times, with the emergence of problems in the practice of western law in China, China has begun to seek a form of rule of law suitable for its own reality. In the period of Nanjing National Government, the grass roots mediation committee was formed on the basis of seeking the model suitable for China's rule of law. Through the analysis of the basic mediation committee in Chongqing and its surrounding areas, it can be found that the status of the mediation committee is mostly the local elite, and there are some defects in the work effect of the mediation committee at the grass-roots level. However, in today's complicated social relations, this kind of administrative mediation mechanism with oriental wisdom can also provide a lot of historical reference.
