【摘要】：黨的十八屆四中全會(huì)通過的《中共中央關(guān)于全面推進(jìn)依法治國若干重大問題的決定》,明確了建設(shè)社會(huì)主義法治國家,促進(jìn)國家治理體系和治理能力現(xiàn)代化,確保人民幸福安康,國家長治久安的方向。然而,全面推進(jìn)依法治國,建設(shè)平安中國,一個(gè)首要的問題就是理清"黨"與"國"、"治黨"與"治國"、"黨規(guī)"與"法規(guī)"之間的關(guān)系,實(shí)現(xiàn)依法治國與依法治黨的有機(jī)結(jié)合。如果我們按照馬克思主義的邏輯,以政治哲學(xué)的思維范式,在中國特色社會(huì)主義的語境中思考問題的話,可以認(rèn)為,執(zhí)政的中國共產(chǎn)黨與人民當(dāng)家作主的中華人民共和國之間、"治黨"與"治國"之間、"黨規(guī)"與"法規(guī)"之間客觀地存在著共存共生、互動(dòng)共進(jìn)的耦合關(guān)系。這種耦合關(guān)系要求我們在全面推進(jìn)依法治國中,必須努力形成國家法律法規(guī)和黨內(nèi)法規(guī)制度相輔相成、相互促進(jìn)、相互保障的格局。
[Abstract]:The "decision of the CPC Central Committee on comprehensively promoting the Rule of Law on several important issues" adopted by the fourth Plenary session of the 18th CPC Central Committee clearly establishes the building of a socialist country ruled by law, promotes the modernization of the national governance system and governing capacity, and ensures the well-being and well-being of the people. The direction of national stability. However, to comprehensively promote the rule of law and build a peaceful China, one of the most important issues is to clarify the relationship between "party" and "country", "ruling the party" and "ruling the country", "party rules" and "laws", and to realize the organic combination of governing the country according to law and administering the party according to law. If we think about problems in the context of socialism with Chinese characteristics according to the logic of Marxism and the thinking paradigm of political philosophy, we can think that Between the ruling Communist Party of China and the people's Republic of China, between "ruling the Party" and "governing the country", and between the "Party rules" and "laws", there exists a coupling relationship of coexistence and interaction and mutual progress between the ruling Communist Party of China and the people's Republic of China. This kind of coupling relationship requires us to form a pattern of national laws and regulations and inner-party laws and regulations that complement each other, promote each other and guarantee each other in promoting the rule of law in an all-round way.
