【摘要】：法人類(lèi)學(xué)研究重視個(gè)體行為與共有規(guī)范之間的相互關(guān)系,制度分析對(duì)法的詮釋為法人類(lèi)學(xué)加入了一個(gè)中觀研究視角,在"法"這個(gè)維度層面拓展出更廣泛的探索空間。基于制度過(guò)程性研究所提供的這套群體共識(shí)框架中的個(gè)體行為測(cè)度方法,以制度作為法人類(lèi)學(xué)場(chǎng)景研判和行為溯源的觀察線(xiàn)索,可以實(shí)現(xiàn)對(duì)于研究對(duì)象時(shí)空范疇中行為點(diǎn)、軌跡線(xiàn)和價(jià)值結(jié)構(gòu)面三個(gè)要素的整體把握,從而建構(gòu)規(guī)范性與行為性相結(jié)合的研究路徑。
[Abstract]:The study of legal anthropology attaches importance to the relationship between individual behavior and common norms. The interpretation of law by institutional analysis adds a mesoscopic perspective to legal anthropology, and expands the exploration space in the dimension of "law". Based on the method of individual behavior measurement in the framework of group consensus provided by the Institutional process Research Institute, using institution as the observation clue to study the scene of legal anthropology and traceability of behavior, we can realize the point of behavior in the spatio-temporal category of the object of study. In order to construct the research path of the combination of normality and behavior, the track line and the value structure face are grasped as a whole.
