【摘要】：整個(gè)西方法律思想史，就是一個(gè)幸福追求史。眾多思想家對(duì)法律是什么的不懈探尋中，法律建構(gòu)何以更體現(xiàn)并促進(jìn)幸福，有意無(wú)意間這成為眾思想家最易思考的主題。對(duì)西方法律與幸福觀的歷史流變進(jìn)行梳理，得出法律應(yīng)認(rèn)真對(duì)待共同體，構(gòu)架復(fù)合多元的共同體和返回幸福之本，德性之源，整合幸福的雙重內(nèi)涵，是法律與幸福關(guān)聯(lián)的根基。 法律是以人為邏輯起點(diǎn)，幸福作為人生的終極追求和追求的永恒價(jià)值，理應(yīng)成為法律關(guān)注的焦點(diǎn)。但由于幸福觀念的撲朔迷離與人類文明中的公共領(lǐng)域的萎縮和人的價(jià)值觀念多元化導(dǎo)致幸福缺位于現(xiàn)代法律價(jià)值，且由于作為“幸�！庇^念的法律替代物也不能完全代替幸福，所以幸福本身終極的價(jià)值意義最適合作為法律的終極價(jià)值。 生活世界是以人和人的生活為中心的世界，實(shí)質(zhì)上是探討優(yōu)良和最幸福的生活的觀念。作為以人的生活世界為基礎(chǔ)的法律，通過(guò)法律中人之形象“幸福人”的建構(gòu)，可使法律的幸福價(jià)值彰顯�！靶腋Ｈ恕钡男蜗笤诜缮鲜且粋�(gè)總括性假設(shè)，，是諸部門(mén)法的人之形象的諸多特性的集合呈現(xiàn)，它在憲政上的架構(gòu)是在否定性框架上極具豐富的概括性內(nèi)涵，具有廣闊權(quán)利發(fā)展空間。 應(yīng)然意義上，法治是幸福的保障，幸福是法治的應(yīng)有之義。實(shí)然意義上，可以通過(guò)法治幸福指數(shù)的構(gòu)建，讓幸福判斷法治建設(shè)成效，讓幸福解釋權(quán)回歸公民自身。進(jìn)而得出幸福法治應(yīng)該成為我國(guó)法治建設(shè)的新思維，將人民幸福作為評(píng)價(jià)法律的依準(zhǔn)，切實(shí)保障人追求幸福的權(quán)利。
[Abstract]:The whole history of western legal thought is a history of pursuit of happiness. In the unremitting exploration of what the law is by many thinkers, the construction of law reflects and promotes happiness, consciously or unintentionally, which is the most easy topic for thinkers to think about. By combing the historical evolution of western law and the concept of happiness, it is concluded that the law should seriously treat the community, construct a complex and pluralistic community and return the root of happiness, the source of virtue, and integrate the dual connotation of happiness, which is the foundation of the relationship between law and happiness. Law is the starting point of human logic, happiness as the ultimate pursuit of life and the pursuit of eternal value, should become the focus of law. However, due to the confusion of the concept of happiness, the shrinking of the public sphere in human civilization and the diversification of human values, happiness is absent from the modern legal value, and because the legal substitute for the concept of "happiness" cannot completely replace happiness, Therefore, the ultimate value of happiness itself is most suitable for the ultimate value of law. The world of life is a world centered on people and their lives. In essence, it is the idea of exploring the best and happiest life. As a law based on the world of human life, the value of happiness of law can be revealed through the construction of the image of "happy person" in law. The image of "happy person" is an all-inclusive hypothesis in law, and a collection of many characteristics of the image of people of all branches of law. Its constitutional framework is full of broad connotations in the negative frame. Has the broad right to develop the space. As it should be, the rule of law is the guarantee of happiness, and happiness is the proper meaning of the rule of law. In fact, we can judge the effect of the rule of law by constructing the happiness index of the rule of law, and let the power of interpretation of happiness return to the citizens themselves. It is concluded that the rule of law of happiness should become a new thinking in the construction of the rule of law in our country. The people's happiness should be regarded as the right to evaluate the law and ensure the right of people to pursue happiness.
