【摘要】：人大立法聽證的效力是聽證制度中的核心問題。隨著我國(guó)法治建設(shè)的不斷深入，人們程序理念的不斷增強(qiáng)和程序法治化進(jìn)程的日益推進(jìn)，為了提高立法的質(zhì)量和擴(kuò)大民主，我國(guó)應(yīng)當(dāng)確立立法聽證程序和聽證報(bào)告的效力。借鑒國(guó)內(nèi)外立法聽證的理論和實(shí)踐經(jīng)驗(yàn)，我們應(yīng)在立法上明確規(guī)定聽證程序和聽證報(bào)告的效力，使聽證報(bào)告成為人大立法機(jī)進(jìn)行立法活動(dòng)的重要依據(jù)和參考，，并以此推動(dòng)我國(guó)人大立法制度的創(chuàng)新與完善，促進(jìn)立法聽證制度功能的充分發(fā)揮，有效地實(shí)現(xiàn)社會(huì)主義民主，維護(hù)公民的知情權(quán)、參與權(quán)、表達(dá)權(quán)和監(jiān)督權(quán)。
[Abstract]:The effectiveness of the legislative hearing of the people's Congress is the core issue in the hearing system. With the deepening of the construction of the rule of law in our country, the continuous enhancement of the concept of people's procedure and the advancement of the process of ruling by law, in order to improve the quality of legislation and expand democracy, our country should establish the procedure of legislative hearing and the effectiveness of hearing report. Drawing on the theory and practical experience of the legislative hearing at home and abroad, we should clearly stipulate the hearing procedure and the effectiveness of the hearing report in legislation, so that the hearing report becomes an important basis and reference for the legislative activities of the legislature of the National people's Congress. In order to promote the innovation and perfection of the legislative system of the National people's Congress of our country, promote the full play of the function of the legislative hearing system, effectively realize socialist democracy, safeguard the citizens' right to know, participate in, express and supervise.
