【摘要】：我國頻發(fā)的"醫(yī)鬧"事件引起了廣泛學(xué)術(shù)關(guān)注,但是少有研究從中觀層次討論"醫(yī)鬧"事件形成的影響因素。本文借用抗?fàn)幯芯糠妒?從資源視角、替代性機(jī)制視角、情感視角三個(gè)視角討論了"醫(yī)鬧"參與者的行為邏輯。統(tǒng)計(jì)資料和個(gè)案研究表明,"醫(yī)鬧"的形成受多重影響。首先,正式制度專業(yè)化糾紛解決能力的高低與患者"醫(yī)鬧"的概率呈負(fù)相關(guān)關(guān)系;其次,患者的求償意愿與"醫(yī)鬧"事件發(fā)生的概率呈正相關(guān)關(guān)系;再次,患者在醫(yī)療糾紛中的情緒因素會(huì)顯著影響"醫(yī)鬧"事件的發(fā)生。中國"醫(yī)鬧"事件中的患方需求可劃分為經(jīng)濟(jì)性訴求、倫理性訴求和情感性訴求,通過剛性治理和法律治理的醫(yī)療糾紛解決途徑重經(jīng)濟(jì)性訴求,輕倫理性和情感性訴求,偏重于解決集體型"醫(yī)鬧",因而難以遏制個(gè)體型"醫(yī)鬧"。由第三方社會(huì)組織主導(dǎo)的"柔性治理"模式或可提供由國家到社會(huì)的沖突治理新思路。
[Abstract]:The frequent "medical noise" events in China have attracted extensive academic attention, but few studies have discussed the factors influencing the formation of "medical noise" events from the meso level. From the perspective of resources, alternative mechanism and emotion, this paper discusses the behavioral logic of participants in "medical trouble" by using the paradigm of protest research. Statistical data and case studies show that the formation of the "medical scene" is affected by multiple factors. Firstly, there is a negative correlation between the professional dispute resolution ability of the formal system and the probability of the patient's "medical noise"; secondly, there is a positive correlation between the patient's desire for compensation and the probability of the "medical noise" event; thirdly, there is a positive correlation between the patient's desire for compensation and the probability of the "medical scene". Patients' emotional factors in medical disputes can significantly affect the occurrence of "medical troubles". The needs of the patients in the "medical affairs" incident in China can be divided into economic demands, ethical appeals and emotional appeals, and the ways of resolving medical disputes through rigid governance and legal management emphasize economic demands, while neglecting ethical and emotional demands. Emphasis is placed on solving collective "medical troubles", so it is difficult to contain individual "medical troubles". The flexible governance model led by third-party social organizations may provide a new idea of conflict management from state to society.
